Farming in tax law

BIM55051 – Farming in tax law: definition of farming

S9 Income Tax (Trading and Other Income) Act 2005, S996(1) Income Tax Act 2007 (ITA 2007), S36 Corporation Tax Act 2009, S1125 Corporation Tax Act 2010 (CTA 2010)

Farming is treated for the purposes of both Income Tax and Corporation Tax as a trade whether or not the land is managed on a commercial basis and with a view to the realisation of profits.

Farming is defined in both the ITA 2007 and the CTA 2010 as being the occupation of land wholly or mainly for the purposes of husbandry but excluding any market gardening.

Although for the purposes of defining farming for tax purposes no restriction is put on where the land is situated, the automatic treatment of farming as a trade is restricted to land farmed within the United Kingdom.

Three features of this definition are considered as follows:

occupation of land (BIM55055)

in the United Kingdom (BIM55095)

wholly or mainly for the purposes of husbandry (BIM55100)

Significance of definition

The definition is of significance because a number of statutory provisions apply, or refer, specifically to farming. These include:

All farming to be treated as a trade (see BIM55110), and all farming carried on by a particular person (or partnership or body of persons) to be treated as a single trade (see BIM55115).

Averaging of profits (see BIM83000 onwards).

Herd Basis (see BIM55500 onwards) (although not restricted to farming).

Restriction of loss relief where losses incurred in the five previous years (see BIM85600onwards).

A tale of two MPs

According to Hansard – in the current Parliament:

Hugo Swire has spoken 25 (no breakdown of whether speeches were in relation to his Foreign Office post or other matters) and has been present for 55.76% of votes.

Neil Parish has spoken 61 times and has been present for 84.77% of votes.

However, Mr Swire is Minister of State at the Foreign Office with special responsibility for India, the Far East, Latin America and the Falklands, as well as Australasia so that must keep him pretty busy.

Time is a Tardis …..

As part of 14/2032/CPE planning application to get rid of the agricultural covenant on his home, disgraced ex-councillor Graham Brown has provided a cash flow document of his income from various sources over the last 10 years.

From this document, it appears that he spent the same amount of time on public service in 2013 (when he was a councillor for 3.5 months) as he did in the whole of the 12 months of 2008 when he was a district councillor, chair of EDBF, member of COC, Business Champion, Chair of the LDF panel and Deputy Leader.

A public meeting is being arranged on this urgent matter to discuss the situation in Ottery St Mary on 7 October – more details to follow.

In the meantime MP for the Ottery and Sidmouth area, Hugo Swire, has apparently said this is “not the time for whipping up excitement” and, on the bright side, means more time and space for clinics:
