“The Deputy Leader of Westminster Council has resigned following an internal investigation into his conduct.

Deputy Leader Robert Davis announced today he is to resign “with immediate effect” after 36 years of service.

Mr Davis’s resignation comes after he reportedly accepted hospitality or gifts 893 times over six years. These gifts frequently came from property developers who were seeking planning permission, according to the Guardian.

In a statement, Mr Davis said: “I am very proud of my 36 years’ service in local government during which I made a major contribution to the wellbeing of the City and its people.

“Earlier this year there was some press coverage concerning the hospitality I received during the course of my duties. To avoid this becoming an issue in this year’s elections, I agreed to refer myself to the Monitoring Officer, and stand aside as Deputy Leader while an investigation was carried out.”

Mr Davis, who chaired the Conservative borough’s planning committee for 17 years, continued: “My approach to declarations has always been to be honest, open and transparent. I have nothing to hide.

“I registered all my hospitality and it was posted by officers on the Council’s website. I have been making such declarations since 2007 when the requirement was first introduced.

“I also declared any relevant interests at the beginning of every planning committee I chaired during this time. I have acted with the utmost transparency and probity at all times and have only ever taken decisions on the basis of what I thought was best for Westminster.

“An inquiry has been completed by the Council. They have confirmed that none of the declarations I made or hospitality I received influenced decisions I took as a councillor and that nothing I did was unlawful.”

He said his actions “created a perception that was negative to the Council.

“While I dispute this, I wish to draw a line under the matter. It is now time for me to move on to the next stage in my life, and for the next generation of councillors to lead Westminster.”

“Shoebox Britain: how shrinking homes are affecting our health and happiness”

“… Jenny pays £475 a month, excluding bills, for one of the smallest of nine flats carved out of a Victorian terraced house on a busy road. One of them is not more than a glorified shed crammed into the garden. She doesn’t know the floor area, but planning documents show that her room, which includes a double bed, kitchen sink, hob, oven, washing machine and a clothes rail, covers 15 sq metres. The tiny, windowless bathroom adds 3 sq m. Her whole home is barely bigger than the average living room and would fit 14 times on to a tennis court.

“When I come home I feel this sense of doom,” Jenny says. “I can’t have the window open because I’m on a noisy, polluted road, and I can’t have the blinds open because there’s a bus stop right there. I’ve had people weeing on my doorstep, doing crack outside my front door.” There are practical challenges. Jenny eats on her bed, which, like her clothes and everything else she owns, smells of whatever she cooks. Without proper storage, anything out of place can make the flat feel chaotic. The hum of the fridge keeps her awake at night.

“I think that even if someone didn’t suffer from anxiety or depression, living in this flat would affect them mentally,” she says, wondering how she might start to recover in a house like this. “You feel it – oh my God, the air is so … heavy.”

… But standards and ideals can get blurred in a vicious economic cycle. Ministers relax planning rules to enable more building and development. Developers and landlords find profitable loopholes in those changes. Local authorities, desperate for alternatives to their own dwindling housing stock, direct residents to those landlords, fuelling further exploitation at a time when councils also lack resources for planning and building control. Residents, often faced with homelessness, endure the cramped results, until society notices and someone writes another report.

“My concern is that people are becoming inured to something that they shouldn’t have to put up with,” says Julia Park, the head of housing research at architectural firm Levitt Bernstein. She has written a history of space standards and is surprised by how little we consider the effects of domestic confinement. “When you’re living in smaller and smaller flats, you reach a point where it makes sense to take out the walls because one big room feels nicer, but I think that implies a lot of compromise we’re not examining,” she says. “Some of these flats pose threats to physical health, but, in small spaces, it’s going to be mental health that is most affected.”

… Park, who advises local authorities, laments the way sleeping, cooking and washing are increasingly viewed as the only functions of a dwelling in a housing market where a living room is becoming a luxury. She is especially worried about the types of homes that have emerged in the gaps in policy. This summer, she noticed a seven-floor former office block in Croydon, in south London that had been divided into flats. Planning records showed that each of the six upper floors in the building had been converted into 10 studios, including single flats of just 13 sq m.

By current standards, these flats are barely a third of the recommended size. Park was instrumental in drawing up the “nationally described space standard”, a nationwide metric implemented by the government in 2015. It recommends 37 sq m for a one-person, one-bedroom flat; a two-person, one-bedroom flat should be 50 sq m.

Park was surprised that the government had agreed to the recommendations, given its austerity policies. “The compromise was that it is optional,” she adds, estimating that fewer than half of councils have adopted it. Even when they do, it only applies to new buildings or developments that go through the planning system, but not to a range of “permitted developments”. So, for a relatively small investment, the owner of an office building, for example, can convert it into self-contained flats with only “prior notification”.

Ben Clifford led a team that visited more than 500 converted office buildings for a report published last May by the Royal Institution of Chartered Surveyors. “We were shocked by how many of these flats were of a very poor quality,” says Clifford, a senior lecturer in spatial planning and government at University College London’s Bartlett school of planning. In one, Clifford called the fire brigade after spotting walls dividing flats made only of plywood. “We spoke to one resident who was in a tiny one-bed flat with two children and no balconies or open space,” he says. “Another woman, in an 80s office building, said it just wasn’t very nice to live in a flat with big tinted windows that don’t open.”

In the so-called “lockdown” model, meanwhile, rogue landlords are converting family homes into tiny studio flats specifically to attract tenants aged 35 or over who, like Jenny, claim the higher housing allowance for a self-contained dwelling. By including a token shared facility, such as a tiny kitchen – or by ignoring rules altogether – these landlords also bypass planning permission by treating such developments as flat-shares (another permitted development). The rental income from six cheaply built studios is multiples of that for a three-bed flat share in the same house – and it is the taxpayer who lines the landlord’s pockets. “It’s basically the warehousing of homelessness,” says Jon Knowles, a computer analyst and campaigner who has recorded hundreds of such developments.

… Few housing campaigners have much hope that conditions might soon improve for the occupants of our shrinking homes. Clifford says there is a minor backlash against abuses of the permitted development rules, and several local authorities are moving against them. “We have to be much tougher on landlords and on standards,” Park says. “There are going to be compromises because we are desperately short of housing, but we cannot give people a free pass.” … “

Ministers must give reasons for calling-in and also for NOT calling-in planning applications

Big change from recent practice and a victory for SAVE.

“Ministers must follow published government policy and give reasons for call-in decisions on planning applications – including in those cases where the decision is not to call in, the Court of Appeal has ruled.

The case of Save Britain’s Heritage, R (on the application of) v Secretary of State for Communities and Local Government & Ors [2018] EWCA Civ 2137 concerned the Secretary of State’s decision, dated 15 March 2017, not to “call in” certain planning applications dealing with the controversial ‘Paddington Cube’ development.

SAVE argued that the Secretary of State was required in law to give reasons for that decision, and failed to do so. It put the case in two ways:

There was a legitimate expectation that reasons would be provided, based on a promise made in 2001 by the then Attorney General Lord Falconer. Although the Secretary of State accepted that it was the practice for many years to give reasons for not calling in an application (pursuant to s.77 of the Town and Country Planning Act 1990), the Secretary of State argued that this practice came to an end in 2014 and that SAVE knew or ought to have known about that change. SAVE maintained that, as a matter of principle, a published policy cannot be withdrawn or overturned by an unpublished practice.

The Secretary of State had a general duty at common law to give reasons for any decision under s.77 and/or that there was such a duty on the particular facts of this case. This argument was contrary to a number of first instance decisions and was advanced principally by reference to the decision of the Supreme Court in Dover District Council v CPRE Kent [2017] UKSC 79.

When granting SAVE permission to appeal, Lord Justice Lewison limited that appeal to SAVE’s claim for a declaration “that the SoS was required to give reasons for any decision whether or not to call in applications for planning permission and/or listed building consent for his own determination under s.77”. The planning permission granted by Westminster City Council on 14 August 2017 still stands.

The Court of Appeal ruled in SAVE’s favour. Lord Justice Coulson considered that the particular facts of this case did not require the common law to impose a duty to give reasons when none would otherwise exist.

In relation to the legitimate expectation issue, Mrs Justice Lang had concluded in the High Court that by 2016/2017, there was no longer an established practice that reasons would be given for a decision not to call-in an application. “On the contrary, the established practice was that reasons would not be given.”

Lord Justice Coulson decided that this conclusion was erroneous for three reasons:

The judge’s may appeared to confuse the promise cases with the practice cases. “I accept that, if a legitimate expectation was created as a result of a particular practice then, if that practice was changed, the legitimate expectation might well disappear with it. But that is not this case. This case is based on the unequivocal promise made by the relevant Minister in Parliament which has never been publicly changed.”

It was “a recipe for administrative chaos if a legitimate expectation can be generated by an unequivocal ministerial promise, only for it then to be lost as a result of an unadvertised change of practice.” Even at its highest, the Secretary of State’s case stopped short of the suggestion that the alleged change of practice was advertised as such when it occurred in 2014. Ms Lieven QC [counsel for the minister] properly accepted that it was not a change that could be said to have been ‘published’ at all.”

It was “worth noting how and why the SoS says that this change of practice occurred. It appears that, in the Westminster case, the Minister had given reasons for not calling in the decision which were plainly wrong on their face. As a result of this error, somebody (and it is quite unclear who) within the Department for Communities and Local Government decided that it would be more prudent for reasons not to be given under s.77. In consequence, changes were made to the template letter sent out (to the relevant LPAs, or to the objectors who had requested call in) when a decision was made not to call in an application under s.77. Mr Harwood QC [counsel for SAVE] was therefore right to say that this was not an open or transparent way to withdraw a public ministerial promise made in Parliament.”

The Court of Appeal judge said he was unpersuaded that the alleged change to the template letter was of any real significance.

Lord Justice Coulson continued: “Since a promise had been made to operate a particular procedure then, as a matter of good administration and transparent governance, any change to that policy also had to be announced publicly.

“It is a not a question of fettering the future exercise of discretion, but simply making public the decision that something which had been promised and provided in the past would not be provided in the future. In my view, good administration and transparent government required nothing less. Of course, this did not happen here because no-one in the Department knew that they were changing a promised policy (because they had forgotten about it).”
Lord Justice Coulson added: “I do not accept the proposition that a policy which has been promised can then be withdrawn simply by a change in the template of letters sent privately to individual LPAs and objectors, particularly where, as here, the alleged change is itself very difficult to discern.”

He said: “An unequivocal promise was made, and that unequivocal promise should have been publicly withdrawn when (or if) a conscious decision was taken no longer to give reasons for not calling in applications …. For these reasons, I consider that SAVE’s legitimate expectation case has been made out.”

SAVE said the ruling meant that the Secretary of State for Housing, Communities and Local Government must now follow his own published advice and give reasons for his decisions.

Henrietta Billings, director of SAVE Britain’s Heritage, said: “This is a fantastic result that opens up the decision making process for highly contested major schemes across the country. It literally changes the landscape of decision making – and is a major victory for openness and transparency.”

Greendale exploits planning loopholes yet again

“FWS Carter and Sons were successful in obtaining planning permission for 2 further agricultural buildings at Hogsbrook Farm, next to their Business Park at Woodbury Salterton.

The 2 planning applications were debated at East Devon’s Planning meeting on Tuesday 2nd Oct at the Knowle Sidmouth. The 2 planning applications were17/2430/MFUL and 18/0920/FUL for large agricultural sheds at Hogsbrook Farm. They were both recommended for approval by the planning department.

Although the Planning Committee were reluctant to grant planning permission for these 2 buildings only 18 months after a planning inspector overturned the committee’s decision to refuse 2 similar units being changed from agricultural use to industrial, because it was claimed they were redundant for agricultural and their remaining cattle sheds a facilities were more than adequate for their farming needs for the foreseeable future.

Yet within a short space of time after the previous units were converted to Industrial use the company applied for these 2 further agricultural buildings due to the alleged expansion to their farm business.

It was pointed out that there have now been many similar applications at Greendale and Hogsbrook Farm where agricultural building have changed to industrial or business use due to the company claiming that they were no longer needed for their agriculture needs.

Committee members were concerned that although it seemed obvious that FWS Carter and Sons are “cynically abusing” the planning system and conditions attached to previous applications which had tried to control these changes, that have by default allowed the Business Park to expand considerably and in an uncontrolled manner.

The planning officer stated that the Government and East Devon planning regulations could unfortunately not prevent these applications being approved, as the applicant had submitted an agricultural justification statement, and the applications complied with all the legal requirements, but he agreed to recommend a legal clause that should prevent the applicant from converting these further 2 units to industrial or business use in the future.

District Councillor Geoff Jung a planning committee member and the local Councillor for Raleigh Ward which includes Woodbury Salterton said after the meeting.

“There are now more than a dozen massive Industrial units at Greendale and Hogsbrook Farm which were all retrospectively changed in use and later granted permission for industrial use.”

“I totally support encouraging businesses to expand and I totally support farmers to expand and diversify and I am all for the welfare of the animals.”

“But we are also the custodians of our countryside which needs protection from uncontrolled development.”

“It very disappointing to the local community that a local developer and landowner, FWS Carter and Sons, have been successful in working the planning system.”

“I do hope the legal draft to be added the planning permission will now prevent further applications of this nature”

Another developers’ charter announced by government

“The government has announced plans to consult on further reforms to the planning system, including giving local authorities more flexibility to dispose of surplus land that could instead accommodate new homes.

Other measures will include

introducing a new permitted development right to allow property owners to extend certain buildings upwards, “while maintaining the character of residential and conservation areas and safeguarding people’s privacy”.

clearer guidance to give more certainty for communities when land is needed to make a new town a reality.

The government has set a target for the delivery of more than 300,000 homes a year by the mid 2020s.

The Secretary of State for Housing, Communities and Local Government, James Brokenshire, has also confirmed that the government will ban the use of combustible materials on external walls of high-rise residential buildings. The ban will also apply to hospitals, care homes and student accommodation over 18 metres.

This ban will be delivered through changes to building regulations guidance and will limit materials available to products achieving a European classification of Class A1 or A2.

Other measures announced by the government include the creation of a New Homes Ombudsman to support homebuyers facing problems with their newly built home, and £165m in funding to unlock up to 5,100 homes in Birmingham in support of the 2022 Commonwealth Games.”

Beware council promises – an example from Teignbridge

“Plans for a new country park serving the 2,500 homes to be built on the edge of Exeter are being cut back, it has been claimed.

The 70-hectare park (173 acres) in the area of the new homes around the Devon Hotel is being dropped by Teignbridge District Council in favour of one that is much smaller, says local county councillor Alan Connett.

Cllr Connett says he has uncovered the council’s plan for a park less than two-thirds the size of the original plan, at 39 hectares (96 acres).

He said: “Teignbridge’s own Local Plan, which sets out how the district will develop over the next 20 years, promises a ‘ridge top park of approximately 70 hectares’. “However, we see yet again how the council promises the earth and then quietly changes the plan.”

In a confidential report going to Teignbridge Council’s Executive committee on Tuesday, October 2, Mr Connett said it was understood the ruling Conservative councillors would be asked to back a new, smaller countryside park for the South West of Exeter development.

Cllr Connett, a Liberal Democrat, said: “Teignbridge now wants to concentrate on a country park that is over a third smaller than it promised residents. “Much of the development at South West Exeter is, in fact, in the parish of Exminster, which will see an extra 2,000 houses within the community, and just 500 ‘over the border’ in Exeter.

“The ridge top park is seen as an essential part of the development not only to provide open space for the residents who will live in the new homes but also to take pressure off the Exe Estuary and reduce the number of visitors.

“This is another example of the planning system promising one thing but delivering less than that promise.

It was the council that put forward a country park of approximately 70 hectares but now, in a secret meeting not open to the Press or the public, and without any consultation, it plans to renege on that promise.

“This is why local people lose faith in the planning system and don’t believe councils when they say good quality community benefits will be gained from large scale housing developments.

“Of course, a park of 96 acres will still be a big space to walk dogs, enjoy picnics and family time together, but that is not the point. “The park will be part of the community for ever more, we hope, and it’s already being downsized.

“As Exeter and Teignbridge continue to grow in the years to come, future generations will come to regret that the Park was not the promised 70 hectares.

“Also, as a local councillor I am now gagged and prevented from saying more about what I have uncovered because the council has ensured all this is being discussed in private, in secret session.”

“Teignbridge says it is an ‘open and transparent’ council, but yet again we see it is anything but that. “It prefers to do its business and cut back on its promises in a private meeting which the public are not allowed to attend.”

A spokesman for Teignbridge Council said Teignbridge adopted its Local Plan in 2014 and at the time the Plan’s independent Inspector noted that the Suitable Alternative Natural Greenspace allocation at South West Exeter was sufficient to address the impacts planned development, as well as possible needs in the future.

He said: “The same year, a masterplan for South West Exeter was publicly consulted on and adopted by the Council.

“It explained that 36 hectares of the 70 hectare allocation were needed to accommodate planned development and that the allocation of the larger area therefore provided longer term flexibility.

“The additional provision to the total of 70 hectares indicated was put in there to provide greater flexibility for the countryside park to expand in the future.

“In all cases the land areas being talked about are significantly larger than Dawlish countryside park.”

Cllr Humphrey Clemens, Teignbridge’s Deputy Leader and Executive Member for Housing and Planning, said: “In line with council procedure, Cllr Connett has had the opportunity to raise any questions in advance of the Executive and I welcome the opportunity to have an open discussion with him during the meeting.”

“Ireland sets up land agency as anger grows at housing shortage”

“… Despite being left with a surplus of houses after a 2008 property crash cut values in half, Ireland has been falling far short of the 35,000 new builds analysts say are needed annually just to keep up with demand from an economy and population growing faster than any other in the European Union.

Modelled on similar bodies in Germany and the Netherlands, the Land Development Agency (LDA) will be tasked with opening up land owned by local authorities, state departments, semi state bodies or in some cases the private sector to build 150,000 new homes over the next 20 years.

“We are acknowledging the reality that some of the sites that are causing this issue are in the ownership of public bodies,” Finance Minister Paschal Donohoe told a news conference.

“The adoption of a more pro-active land management role by the state is critical to solving the current housing crisis and creating downward pressure on land prices.”

Land for 3,000 units has already been secured from state bodies by the LDA, the government said, including, for example, by moving the country’s central mental health facility out of a Dublin suburb more suited to the construction of houses.

“Ireland has a poor history of managing its land in a sustainable way. This has resulted in inefficient use, sprawl and volatile price cycles,” Dermot O’Leary, chief economist at Goodbody Stockbrokers wrote in a note.

“While the impact from such an agency will not be felt immediately, it will be a welcome addition to the housing policy toolkit to aid in preventing some of the mistakes of the past.”

“Ombudsman offers practical guidance to planners when recording decisions”

“The Local Government and Social Care Ombudsman has issued new guidance for planners when recording the decisions they make.

The Ombudsman receives more than 2,000 complaints and enquiries each year about English local authorities’ planning functions.

Common areas in which the Ombudsman finds fault with the decision-making process include failing to explain properly the reasons for decisions, or overlooking material considerations.

Based on real casework examples, the learning points in the report offer clear, practical steps planners can take to ensure the decisions they make are evidenced and recorded properly.

Local Government and Social Care Ombudsman, Michael King, said:

“Communities can only have confidence in the planning process if councils fully and accurately record the reasons for their decisions, including the information they have taken into account to make them.

Otterton residents worried about holiday park expansion take note

“Plans to expand a holiday park near Ashford have been refused by North Devon councillors.

Park Holidays UK’s plan to accommodate as many as 116 caravans and build a clubhouse complete with a swimming pool, amusement arcade, shop and entertainment room at Tarka Holiday Park was discussed by North Devon Council’s planning committee on Wednesday.

Councillors unanimously refused the application, which would have included a new roundabout to serve the entrance at Braunton Road, and the decision was met by a round of applause from a group of around 30 Ashford residents who attended the meeting at Barnstaple Rugby Club.

They cited an adverse impact on the landscape and countryside, the scale of development and the impact on the village of Ashford and other amenities as reasons for refusal.

Councillor Joe Tucker said: “I’ve had quite big concerns about this site in many ways, and we have got grave concerns as a planning committee with the site.

“We are driven so much by national planning policy guidelines made by people sitting in London, it’s a different kettle of fish for people in North Devon.

There are so many fundamental issues with this site. I think it’s dangerous for us as a planning committee to pass through an application with so many issues.”

The committee heard from six village residents, who expressed concerns about the level of noise, the generation of traffic and the impact on a nearby supported living accommodation.

Parish Councillor John Bleech said it was ‘hard to overstate’ the level opposition to the application, noting 138 letters of objection sent to the council.

Ashford resident Dale Hall said: “Ashford strongly objects to the application and all residents fear for their life in the village. The development is too large, too commercial and too close.

“The change from a quiet caravan site into a large entertainment complex should bring noise.

“Tarka say this is a tranquil site but they threaten that tranquility with that application. Ashford will feel betrayed by the local authority if the application is approved.”

The Gazette has approached Park Holidays UK for a response.

“A lobbyist for some of the UK’s biggest property developers used a direct communication channel to the leader of a flagship Conservative council to help push through planning applications for luxury apartment developments.

Peter Bingle used his longstanding relationship with Ravi Govindia, the leader of the London borough of Wandsworth, in attempts to circumvent council officials he believed were being obstructive to his clients, including over the size of payments due to public projects.

Bingle’s access has been revealed in a cache of emails released under the Freedom of Information Act that show him asking Govindia, a former flatmate, to smooth the passage of planning applications for hundreds of luxury homes between 2011 and 2013. Govindia responded in some cases by promising to chase officials and fix meetings.

He set up Terrapin Communications, whose clients have included Ballymore and Bellway, the housebuilders, and Royal Mail when it was selling off its land for housing.

When Royal Mail complained about the junior rank of the planning officer assigned to its application and having to repeat details of its plans to officials, Bingle emailed Govindia: “This wouldn’t have happened under the old regime. Your help would be appreciated in sorting things out.”

Bingle later forwarded the Royal Mail’s plan for its presentation to the Wandsworth planning committee to Govindia asking “What’s your advice?” Govindia replied two minutes later: “Will call as soon as I finish this meeting”.

Nearly 100 London councillors have links to property industry

There is no suggestion of wrongdoing, but the correspondence provides a rare window on the methods developers use to apply pressure to politicians behind the scenes to speed up high-stakes planning decisions and to reduce infrastructure payments. An investigation last week revealed how Berkeley Homes, one of London’s largest developers of luxury homes, routinely told local authorities that their affordable housing targets were unviable.

In April, the Guardian revealed planning lobbyists regularly entertained Robert Davis, Westminster city council’s former planning committee chairman. Davis received hospitality or gifts 893 times over six years, frequently from developers and their agents, including Bingle. He has since resigned as deputy leader.

The emails relate to when Bingle was working as a lobbyist for the Royal Mail, which had submitted plans for a 1,800-home development on its site close to Battersea Power Station. In one email to Govindia he lambasted the council’s handling of a negotiation about how much his client should pay to the public purse as “chaotic and shambolic”. He told Govindia it “does nothing for Wandsworth’s reputation in the property world … Something has gone seriously wrong.”

The planning application was eventually approved. Royal Mail last year sold part of the site to US investors for £101m.

Bingle chased Govindia for updates on progress of another 252-home application at Battersea for another client, complaining about “non-committal” planning officials. He applauded the leader when a separate application for 104 private flats in Putney by Berkeley Homes was approved, signing off an email: “Many thanks for a great result.” It had no social housing.

Bingle has denied exerting any undue influence and Govindia said he made no apology for delivering more homes for Wandsworth.

Public records show Bingle has entertained at least 31 councillors in different London boroughs in recent years, taking some out for lunch or dinner more than a dozen times. When Govindia, who was among those he entertained, was awarded a CBE in 2017 Bingle said: “Never has an award for services to local government been more deserved.”

Govindia did not sit on Wandsworth’s planning committee, but Bingle repeatedly urged him to help, often simply forwarding on complaints from property developers.

In January 2012, Royal Mail was concerned about what the council wanted in terms of payments for schools and education. Bingle forwarded an email about that directly to Govindia saying “Ravi, Views?”

Govindia replied later that day: “I will chase the education chaps”.

By March, the development consultant on the scheme asked Bingle to “prod Ravi that we need to get on with this”. Bingle forwarded the email to Govinidia saying “I thought it simplest just to forward this to you”.

When Bingle sent an email asking: “Leader, Can we get a meeting with you in the diary for next week? This scheme is now stuck,” Govinida replied: “I have asked for an update from planners next week.”

Asked about the relationship Bingle said: “The fact that this information came from a freedom of information request shows that it was always available for scrutiny in the public domain. And rightly so. Having been a long-standing friend of Ravi I know it is impossible for anybody to have undue influence over him. Since his earliest days on Wandsworth as a backbench councillor he has always resolutely defended his own viewpoint even if it meant voting against the Conservative group.”

Govinidia said: “It is first and foremost the job of any council leader to press those on all sides to deliver improvements to their borough and improve the lives of their residents. To do the job effectively you need to listen to all voices and make sure that when problems or snags arise that you are on top of them and that you can secure solutions to drive forward and deliver these improvements. I make no apology whatsoever for fulfilling my role as a council leader to deliver more homes, more jobs and more opportunities for our residents.”

He said the Royal Mail development will deliver 318 new affordable homes, a higher number than the developers were originally offering.”

Firstly, we would like to point out that the Jurassic Coast Trust, as the organisation responsible for the protection of the Jurassic Coast World Heritage Site, should have been formally consulted on this application.
You should also be aware that this application has been raised by the general public with the UK National Commission for UNESCO, with whom we are now liaising.

The core issue for us is the extension of the viewing deck or ‘ice cream deck’ into the World Heritage Site (WHS). The boundary for the WHS is described for this part of the coast in appendix 2 of the Site management plan. Both the full plan and its appendices are available to download freely from http://www.jurassiccoast.org. At Ladram Bay the WHS sits between the break in slope at the top of the cliff and the mean low water mark. The extension of the decking therefore has a direct impact within the Site’s boundaries.

These potential impacts should be considered under the following policies from the WHS management plan:

1.1 Protect the OUV (Outstanding Universal Value) of the site through prevention of developments that might impede natural processes, or obscure the exposed geology, as set out in the GCR / SSSI details, now and in the future.

1.2 Where developments affecting the Site or setting do take place, avoid or at least mitigate negative impact on the natural processes and exposed geology.

1.3 Oppose developments in the Site’s setting that may warrant a future need for coastal defences, particularly in light of potential sea-level rise and extreme weather events.

1.4 Protect the landscape character, natural beauty and cultural heritage of the Site and setting from inappropriate development.

Retrospective planning permission is wholly inadequate to deliver these policies for three key reasons:

1 There is not enough information provided about the nature of the structure and how it is anchored and supported. A proper assessment of its impacts on the WHS is impossible based on this application.

2 Retrospective permission does not allow for the mitigation of impacts within the design process.

3 There is no evidence that alternative approaches that provide similar benefits to the holiday park’s users whilst protecting the natural environment have been considered.

National Planning Policy provides World Heritage Sites with the highest level of protection (see NPPF paragraphs 184 and 194). The long operation and high rating of the holiday park does not excuse the applicant from following proper planning procedures.

If the applicant had followed normal planning procedure, we would have had the chance to comment early on the design, suggest alternatives if necessary or, if deemed to be appropriate development, recommended suitable consent conditions.

Protection of the World Heritage Site relies on the planning system to deliver these opportunities.

We strongly recommend that East Devon District Council refuse this application.”

A coalition of retailers, landlords, councils and pubs has called for planning laws to be reformed so that abandoned shops can be turned into cafes, galleries, gyms and other businesses more easily which could help rejuvenate Britain’s high streets.

It said empty units are often hard to let ­because it can be difficult and expensive to get permission to change their use and is calling for more flexibility in planning legislation to help compete with online businesses. The LGA said it is time to recognise “a contraction in retail floor space” may be needed to help high streets survive.”

“Government faces court action over ‘illegal’ planning policy”

“The government is facing a legal challenge over its new planning policy, which campaigners say was illegally adopted because the government failed to assess its environmental impact.

The revised National Planning Policy Framework, published in July, informs local policies across England, from planning permission to town and country planning and land use. It has significant weight in development decisions, from the amount and location of built development to the way environmental impacts are assessed, and also deals with policies concerning air pollution, energy generation, water management and biodiversity.

A strategic environmental assessment (SEA) is required by EU law for public plans relating to land use and planning, among other things. It is required wherever policies are likely to have a significant impact on the environment. Friends of the Earth wants to force the government to undertake an SEA, consult the public and modify the framework based on those findings.

The NGO has filed a claim at the high court, saying the NPPF makes it “virtually impossible” for councils to refuse local fracking schemes, fails to rule out future coal developments, and introduces harsh new rules for wind energy schemes. It argues it is impossible to gauge the environmental impact of such policies without a strategic assessment. …”

“Land now 51% of UK’s net worth – a huge transfer of wealth to landowners, say campaigners”

“A dramatic rise in land values pushed Britain’s wealth to a fresh high of more than £10tn last year, highlighting the huge gains made by developers in property hotspots across the UK.

From London and the home counties to Cambridge and popular parts of Devon and Cornwall, land values have become the single largest element of wealth, dwarfing household wealth locked up in property and financial savings.

Official figures showed that the UK’s net worth rose by £492bn between 2016 and 2017 to £10.2tn, with the lion’s share of the increase accounted for by a £450bn jump in the value of land.

The rise continues a trend since 2012 that has pushed the average assets held by each Briton to £155,000, up £6,000 from 2016.

The Office for National Statistics said consistent increases in the value of land meant it accounted for 51% of the UK’s net worth in 2016, higher than any other G7 country that produces similar statistics.

In France, which has a land mass twice the size of the UK, land values account for 41% of wealth while in Germany they account for only 26%.

This week several landowners have outlined plans for developments, including the Duke of Westminster’s Grosvenor Group, which said it was taking a growing interest in residential property outside central London.

It said it would build thousands of homes on greenfield sites around Oxford and Cambridge, which are to benefit from Treasury plans to connect the two university towns with a cross-country rail link.

Analysts said much of the increase in land values was in response to Britain’s rising population, which has put pressure on the government to back house builders seeking to develop green field sites and farmland in south-east England and other development hotspots around the country.

The price of farmland can increase by 100 times when developers succeed in persuading ministers to re-designate it for housing. Areas of London that were previously derelict, especially in the east of the capital, have seen huge rises in values as regeneration efforts and improved transport links have fed into property prices.

Commercial property has also enjoyed an upswing in value since Britain’s recovery following the 2008 banking crash, more than offsetting recent declines in much of the retail sector.

The ONS figures go beyond a study last year by Lloyds bank that showed that Britain’s net worth had climbed above £10tn for the first time, but did not single out the value of land.

The steady increase in land values is expected to trigger further calls for a land value tax or new rules allowing local authorities to reap the rise in values by allowing them buy land earmarked for development.

A growing number of thinktanks and politicians support imposing a tax that would take a slice of rising land values.

The Institute for Fiscal Studies has urged the Treasury to develop a scheme, while the Green party co-leader, Caroline Lucas, has tabled a private member’s bill proposing a land value tax. Labour said in its 2017 election manifesto that it would consider a similar tax.

Mark Wadsworth, the head of the Campaign for Land Value Taxation, said: “The minority with a vested interest in high land values will no doubt celebrate higher values, saying that is shows the importance of land to the UK economy.

“In truth, land values are not a net addition to national wealth, they merely represent the benefits that accrue to landowners because of government spending on public services funded out of general taxation; land values are actually just a measure of ongoing transfers of wealth from taxpayers to landowners and a zero-sum game.”

“Britain should limit the windfall gains of landowners by freezing the value of plots newly designated for housing, according to a thinktank urging sweeping reforms to tackle a national shortage of affordable homes.

Calling on the government to pursue land market reforms similar to the German model, the Institute for Public Policy Research said planning authorities should be given new powers to zone land for development and freeze its price.

It said speculation by landowners awaiting planning decisions that can trigger vast increases in the value of a plot, had the effect of exacerbating wealth inequality and was a “driving force behind the broken housing market” in Britain.

Luke Murphy, associate director at IPPR, said: “Conventional wisdom suggests that the UK has a problem with house prices, but the reality is that we have a problem with land.”

The sweeping reforms would mean national and local government organisations would benefit from the extra value generated by planning decisions, which could be used for local infrastructure or affordable housing, rather than landowners accruing massive returns from the state approving changes in the use of land.

Using the example of a hectare of agricultural land in Oxfordshire that would typically be worth about £25,000, the IPPR said it could skyrocket in value by more than 200 times on approval for residential development to be worth about £5.6m. While the landowner stands to benefit from approval, the increase drives up the cost of building homes.

Two years ago on average the price of land had risen to more than 70% of the price paid for a house, which the IPPR said could rise to about 83% over the next two decades given current trends in the housing market. Options to remedy the problem could include councils buying land and selling at higher prices to developers, or entering into partnerships with landowners to share the proceeds of the sale.

About half of net wealth in Britain is tied in up in land, having risen by more than 500% in the past two decades to stand at £5tn. Although the value of property built on land across the country has also risen, it has increased at a much slower rate, of around 219%.

According to a 2010 report for Country Life, a third of Britain’s land still belongs to the aristocracy, while some of the oldest families in the country have held on to their land for several centuries. The IPPR said the top 10% own property wealth averaging £420,000 in value, compared with the bottom 30% who own no net property wealth at all.

Murphy said: “Wealth inequality, a poorly functioning housing market, an economy focused on unproductive investment and macroeconomic instability are all negative consequences of our current speculative land market. … ”

East Devon District Council Strategic Planning Committee are going to discuss:

“Principles for accommodating the future growth needs of East Devon”

on 4 September 2018.

The Committee are being asked to endorse

“The proposed principles for growth” as the basis for future discussion and consultation on accommodating extra growth in the district.”

The document is described as the “start of the debate” for future East Devon growth points for both the GESP (The Greater Exeter Strategic Plan) and the East Devon Local Plan review, which is required to be updated within the next two years.

For the last few years East Devon District Council have achieved their own Local Plan agreed target of 950 dwellings per year. (EDDC Target is 17,100 dwellings between the years of 2013 to 2031).

Recently Central Government decided to calculate each District`s housing requirement targets on a set matrix. East Devon’s build out figure has been set to be 844 homes per year. However, the report suggests that rather than achieve the Government target of 844 new houses per year there is a proposal to build out much higher levels of growth.

The report explains that the objective of higher growth could be achieved by what is called a “Growth Deal” with Central Government where a group of Councils agree to build more housing in return for infrastructure investment from central funds.

This proposed “Growth Deal” is being prepared by the Councils of East Devon, Exeter, Teignbridge and Mid Devon through the “GESP” Greater Exeter Strategic Plan.

It is recognised that Exeter is unable to provide the housing land required to sustain the expected growth of the city, and the rural areas and towns in the rest of the combined area will be required to increase their housing requirements in exchange for the infrastructure improvements for access to and from the city of Exeter.

Improvements to the motorway junctions, new roads, extra park and rides, rail improvements, new stations and an integrated transport system are all identified as priority improvements to overcome the already chronic delays on Exeter`s transport network. There are also aspirations for a “sports hub and concert venue” for Greater Exeter to be included in the GESP infrastructure needs.

The report gives a brief synopsis of the towns in East Devon and concludes that other than the new town of Cranbrook there is limited scope for growth due to the various towns’ proximity to the AONB designated areas, or they are bordering on the coast or close to flood plains.

The conclusion from the report is that the existing towns will only accommodate minimal growth, and with two-thirds of East Devon being included in the AONB of the Pebblebed Heaths or the Blackdown Hills the only area that can accommodate substantial growth is within the North West part of the district.

The report describes this area as the Western most quadrant of this district to the North of Exmouth and West of Ottery St Mary. The land is described to benefit from being relatively flat with no landscape designations. It is also well served by main roads with good vehicle access via the M5, A30, A3052 and A376 and has good existing public transport links with the railway line and existing bus routes.

There are 3 possible ways described as to how development could be achieved in this area.

1. Establish a further new town. Basically, create another Cranbrook. However, the report considers that the creation of another new town in the area could harm the delivery of Cranbrook.

2. Establish a number of new villages. Create a series of modern Devon villages but the report considers that this option would be most damaging in landscape terms.

3. Centre Growth around Existing Villages.

Growth would be required to be substantial with around 400 to 500 extra homes to be added to a number of existing villages (The report does not state how many villages will be required within this area). However, this could harm the character of the village and the existing community.

The new NPPF acknowledges that:

“The supply of a large number of new homes can often be best achieved through planning for larger scale development such as new settlements or significant extensions to existing villages and towns, provided they are well located and designed, and supported by necessary infrastructure and facilities.”

A list of the Parishes within the expansion area for extra housing area

By referring to a map of the area these are the Parishes(villages) which are within the West of the district which could have development of between 400 to 500 extra dwellings, parishes identified could be:

All these Villages are North of Exeter and access is by way of the A377 – which is not listed as one of the featured roads, so it is unlikely these will be included.

These Villages are close to Cranbrook and therefore unlikely to be selected to avoid the villages and town merging.

This Village is already designated in the report to provide growth for Exmouth.

This leaves the following Parishes most likely to be included for further expansion in the proposals:

Clyst St George (includes the village of Ebford)
West Hill
Woodbury​ (includes the village of Woodbury Salterton and Exton)
Farringdon.

The “Principles for Growth” which the committee are being asked to agree to:

• A significant proportion of growth to be in the Western part of the district by either a new town or extending a number of villages or building new villages.

• Plus, modest growth in existing towns with strategic growth around Axminster, Exmouth (including Lympstone), Honiton and Ottery St Mary.

• All other Villages to be encouraged to provide modest growth through their Neighbourhood Plans.

• Focus development on main transport corridors if possible.

Conclusion:

For the last few years, East Devon has successfully complied with the government`s Housing Strategy, with their current Local Plan and at present build out rates, this will over subscribe the Government Building Target until the year 2031.

The Government is not forcing East Devon to co-operate with Exeter to provide some of their housing needs. This decision is totally at the discretion of the District Council and their leaders.

Yes, Exeter is a thriving growth city, and it is recognised that the road and rail connections are dire, but why destroy the character of a part of East Devon for these improvements?

The very reason people choose to relocate to Exeter, its surrounding towns and villages is the beautiful Devon countryside; the building of a mass of new housing will simply make the area a mirror image of the existing areas the people are wanting to move away from!

So, to satisfy the aspirations and needs of the City of Exeter, the rural west area of East Devon will be required to build many more houses with either another new town or new villages or building an extra 500 houses to a number of existing village communities.
