Well done those EDDC Tory councillors! But watch your backs now

Unconfirmed reports suggest that Tory councillors Grundy (Exe Valley) and Pepper (Broadclyst) were the two sensible councillors who voted against the PegasusLife Knowle planning application.

So, no-one can accuse anyone of a “Sidmouth stitch up”.

It seems unlikely that the two councillors will be getting any gifts from under the Tory Christmas tree from Santa Phil Twiss – the official EDDC Tory Whip – who denies ever having used it but who is said to be less than chuffed at the result.

Of course, not being whipped, no-one will expect them to be removed from the DMC for not following non-whipped orders ….

When and how will PegasusLife spring back to life?

Cynics amongst East Devon Watch’s readers (the majority one might suspect) are already considering aspects of yesterday’s refusal of planning permission for the Knowle site.

Of course, there is the prospect of an appeal. But there are also other scenarios being mentioned.

Some suggest that this refusal suits both PegasusLife and East Devon District Council – the former so that it can tweak its application in the light of the current economic climate and resubmit and the latter because a delay in building the new Honiton HQ might be in the council’s own interests, given the same current economic climate and the need to almost certainly raise more money due to increased costs. Also there have been some misgivings expressed by Tory councillors on the design of the new building (which does look rather like a people warehouse) and considered hardly befitting the status and importance of the people warehoused within it:

Others suggest that, as “Greater Exeter” moves ever more quickly (and secretly) forward it might be better for EDDC to cut its losses on a new Honiton HQ which would only be a satellite amongst satellites and therefore not needed to be so large (or maybe not needed at all if the Exmouth premises are large enough). Not to mention the messy complications of devolution and its effect on all district councils in Devon.

Others have even suggested that EDDC has had a better offer from a hotel chain which shall be nameless!

Whatever the reason, we can be absolutely sure that, like the Terminator, it will be back!

Controversial plans to build 113 apartments for older people on the site of East Devon District Council’s offices at Knowle in Sidmouth have been dramatically rejected by the authority’s Development Management Committee.

The decision could throw into jeopardy the council’s planned relocation to new offices in Honiton and Exmouth Town Hall.

To finance the move, East Devon District Council had agreed to sell its Knowle headquarters to Pegasus Life Ltd, which specialises in providing living and care facilities for older people. The sale was subject to a successful planning application.

The council decided to relocate its headquarters in March last year.

It plans to move out of its current premises in Sidmouth to purpose built offices in Honiton and to Exmouth Town Hall, which will be refurbished.

The relocation to Exmouth is due to take place during the latter part of next year, with relocation to the new purpose built offices in Honiton to follow by spring 2018.

But it is not yet clear how the planning committee’s decision will affect these plans.

The planning application by PegasusLife for a 113-apartment assisted living community for older people was refused by the committee by seven votes to six at a meeting on Tuesday, December 6.

Local campaigners and Save Britain’s Heritage had objected to plans to demolish the 19th-century council offices and build on the Knowle Park.

Liz Fuller, buildings at risk officer for Save Britain’s Heritage, said: “The Knowle is an important local landmark building in Sidmouth standing in attractive landscaped grounds.

In our view, the loss of the Knowle and the additional development of the park’s upper lawns and car park as proposed represent a devastating blow to the history and character of Sidmouth, a remarkably well-preserved Regency town in a beautiful setting on the Jurassic coast.

“The long-term benefits of retaining this building should be properly considered as it would serve to secure an important local landmark.

She argued that the proposed development would result in “clear over-development of the site”.

Pegasus Life said its plans would help to meet Sidmouth’s housing need. The company had reduced the amount of proposed accommodation in response to comments from local residents.

The application was refused on the grounds that it was an overdevelopment of the site which would impact on neighbours and the character of the area; that the proposed development should be a C3 use and include affordable housing and not a C2 use, and that it impacts on the setting of an historic building.

PegasusLife now has the option to appeal.”

A transparency campaigner is questioning what district chiefs are ‘so desperate to hide’ after they refused to release correspondence on how a developer for Knowle was selected.

Jeremy Woodward’s Freedom of Information (FoI) requests to East Devon District Council (EDDC) about the decision to sell the site of its headquarters to PegasusLife, and the deal between them, were denied.

He appealed to the Information Commissioner to force the disclosure of two key documents – but the authority again refused as it argues the papers are commercially sensitive. The matter will now go to a tribunal.

Mr Woodward said: “What are they so desperate to hide? Why is the council so determined to avoid being held properly accountable, let alone transparent to its rate-paying electorate?”

The tribunal will not be resolved before PegasusLife’s planning application for a 113-apartment retirement community comes before EDDC’s development management committee (DMC) on Tuesday (December 6).

Mr Woodward added: “This timing seriously puts into question the extent to which the DMC’s decision-making is being compromised. Any information touching on the planning application should be made available to DMC members – and the developer’s contract clearly refers to the planning application.”

He said EDDC would rather incur ‘further embarrassment and potential damage’ to its reputation, as this is the second time it has appealed against a ruling from the Information Commissioner.

Last year, the authority refused to release progress reports Mr Woodward submitted FoI requests for on its relocation project. The eight-month legal battle saw EDDC blasted as ‘discourteous and unhelpful’ and cost taxpayers £11,000 in lawyers’ fees.

After Mr Woodward’s latest challenge, EDDC complied with one of three rulings from the Information Commissioner and revealed that PegasusLife will pay £7,505,000 for the site, subject to planning permission.

A spokesman said EDDC is challenging the ruling on the other two documents on legal and procedural grounds as it believes the Information Commissioner has not applied her own guidance consistently or correctly. It argues that the documents are commercially sensitive – but the spokesman said it has always promised to publish them when this is no longer the case.

The spokesman noted the concerns about the DMC meeting but said contractual terms agreed between two parties is ‘legally an immaterial consideration’ to any planning decision.”

The Local Plan is now ready to depart from Sidmouth …

The agenda for the December 6th DMC meeting makes an interesting read. Two very contentious applications are being considered.

First: The Pegasus Life, Sidmouth scheme is, to quote a planning officer-

“A DEPARTURE FROM THE LOCAL PLAN, providing apartments with extra care in excess of the allocation or requirements of the plan, it therefore makes a meaningful contribution to housing delivery on a largely brownfield site.”

Second: The Syon House, Frogmore Road, East Budleigh scheme is, to quote again-

The application represents A DEPARTURE FROM ADOPTED POLICY as the proposal does not fully accord with Strategy 35 in that a lower than 66% affordable housing provision is proposed.”

It makes Owl think that council tax payers should wonder why East Devon District Council spent a lot of time, money, tears and effort to finally get a local plan adopted just to DEPART from it less than a year from adoption.

Knowle officer decision exposes hypocrisy of planning system

Unsurprisingly, planning officers have recommended the PegasusLife planning application for luxury flats at the Knowle.

Well, be honest, would you go against the wishes of your CEO, deputy CEO and all the Tory councillors?

Yet a very similar (almost identical) planning application in Bath has just been turned down – but that isn’t being built on council land and part- financing a new HQ.

Knowle relocation: EDDC defies Information Commissioner AGAIN and heads for court AGAIN

“EDDC TO DEFY INFORMATION COMMISSIONER – AND TO TAKE FREEDOM OF INFORMATION REQUESTS ON KNOWLE TO TRIBUNAL

East Devon District Council have formally announced that they will only be complying with one of three Decision Notices issued by the Information Commissioner’s Office on 25th October.

They have formally released the already widely-known information that the price for the Knowle site to developers PegasusLife is £7.5 million – on condition that they receive planning permission. (Decision Notice on Case: FER0608237).

However, the Council do not wish to divulge the “minutes of meetings and correspondence on the subject the decision to award the contract to PegasusLife” (Decision Notice on Case: FER0623403) or give “a copy of an agreement between East Devon District Council and a developer, Pegasus Life, in relation to a site at Knowle” (Decision Notice on Case: FER0626901)

It is clear that the Council do not want any information to be revealed about the contractual arrangements it has with the developer. And in particular, they do not want this to happen before a crucial vote by their planning committee on 6th December – when the Development Management Committee will consider the controversial planning application 16/0872/MFUL from PegasusLife.

This timing seriously puts into question the extent to which the DMC’s decision-making is thereby being compromised, in that any information touching on the planning application should be made available to DMC Members – and the developer’s contract clearly refers to the planning application.

PegasusLife jumps the gun …

There was a full page advertisement on the back page of yesterdays Property section of Telegraph for Pegasus with a list of “Developments coming soon” which includes Sidmouth!!

Owl in its innocence thought the DMC meeting this coming Tuesday would
make the decision.

But it seems PegasusLife knows things we don’t. … Nothing new there then.

It will be interesting to see how the DMC talks itself out of a decision very similar to the company’s development in Bath – which was very recently refused, in part because the way the company presented the development, it did not feel that it needed to make provision for affordable housing.

“Compare and Contrast

The highly controversial PegasusLife application for Knowle is to be decided at 10.30 am on Tuesday 6 December in the Council Chamber at Knowle, Sidmouth.

Readers might like to compare it with other recent PegasusLife applications:
1. Bath (assisted living): refused: “excessive and incongruous height”, “harmful impact upon surrounding heritage assets”, “nearby listed buildings undermined”, “the excessive tall building fails to respect its context”, “harmful impact on character and appearance of surrounding conservation area”.

Bristol (Nuffield Hospital site) – officers can’t support due to “excessive bulk and massing”, “doesn’t relate to surrounding context”, would “dominate the townscape”.

Wilmslow: refused: “too large, too high, no affordables”.

Harpenden (retirement flats) – refused due to “height (20.7 metres)”, “lack of privacy for neighbours”, “footprint 28 degrees greater than existing buildings”, “visually intrusive”, “residents’ parking would spill onto neighbouring roads”.

Knowle, Sidmouth (assisted living – or second homes?) – officers approve.

The East Devon District Council’s planning officer, departing from the Local Plan and its planning strategies, claims the the “benefits” to Sidmouth outweigh the harm to an English-Heritage listed building.

“Benefits”? Could he mean

the overbearing, intrusive impact on the park and neighbourhood of an excessively high, out-of-scale massed development?

the loss of heritage buildings and public assets like the Council Chamber where so many people met recently over the proposed hospital bed cuts?

the loss of weekend parking to this tourist town?

the loss of about 100 jobs?

the blot on Sidmouth’s skyline?

the loss to the public of the park’s fine lawn prospect?

the lack of a contribution towards affordable housing?

possible downtown drainage overflow during flash floods?”

Is a cost over-run of £1.1 million or £10 million more serious than a Section 106 loss of £250,000?

Owl asks because an elector successfully petitioned EDDC’s external auditor over Section 106 discrepancies. A sample found a wrongly-attributed bill of some £400,000 and an uncollected sum of around £250,000. As a result, the auditors have requested many changes in procedures:

Now we hear at Cabinet this week that, in two years, development costs for Exmouth seafront have risen from £1.5 million to £3.2 million. Yet Cabinet apparently found this totally acceptable and, without detailed figures, nodded it through with no explanation of:

– what did the £1.5 million cover

and

– what does the extra £1.6 million cover.

Added to this, the projected cost of HQ relocation has risen from cost-neutral (zero due to sale of Knowle HQ for around £7 million) it is now said to be nearly £10 million – or at least that was figure a few months ago.

These are eye-watering numbers yet majority party councillors and auditors (internal and external) appear unconcerned.

How many tiers can “Local” Government take before it collapses?

Owl has lost count of the number of tiers and organisations and partnerships currently interfering in so-called “local” government, see:

Which leads to the question: just how many tiers of government do we NEED and how many can we AFFORD? And how many is too many?

For example, the savings by eliminating district councils, regional super-authorities and makeshift arrangements such as Greater Exeter would almost certainly be huge. You could still have flexible cooperative arrangements such as Strata, without having all the paraphernalia and bureaucracy.

Anyone campaigning for the County Council who includes on their platform local government reorganisation, with County and Parish Councils as the only tiers of local government might well be very popular. It would be possible to combine such a package with maximum localism/subsidiarity. For example, if the District Council was dissolved, all its responsibilities, where practicable, could be transferred to the lower tier councils for truly local management.

Removing two or three tiers of government would almost certainly produce enough savings to eliminate local NHS cuts and debts at a stroke. “Save the NHS by cutting local government bureaucracy” would be a heck of a slogan!

And the elimination of all that bureaucracy and repetitive form-filling and buck-passing could bring enormous efficiency savings and productivity.

In East Devon we would probably be immediately £15-20 million better off just with the cancellation of the new HQ at Honiton.

Whilst many staff would be transferred to town councils to continue to do the jobs that they presently perform, there would probably be a loss over time through natural wastage of perhaps 100 to 200 jobs, representing a cost saving of £3-5 million per annum. Plus reduced operational running costs of around £2 million.

This means a cash windfall of about £300-400 per household to everyone in the District, and average council tax bills would be about £130 lower.

But the big benefit would be in greater efficiency and local connectivity. A huge democratic boost.

A response to PegasusLife Knowle extra documents

Revised drainage and bat mitigation reports and changes to Building E are available on the EDDC website and can be viewed at Council Offices.

Amendments to the design and footprint of Building E and associated landscaping:

EDDC’s Chief Planning Officer’s concerns about the “bulk, scale and massing” * of Buildings D and E resulting from their forward projection as well as their impact on the listed summerhouse and his recommendation that “Building E be set back “ to the existing office footprint “to remove the harm to the setting of the listed building” have received only a token response from PegasusLife, with minor and mainly cosmetic changes that do little to address the issues.

Although Building E has been set back a few metres it will be on higher ground and the equivalent of at least 60 feet high, dwarfing the listed folly. Its impact will be at least as serious as was the previous proposal, especially as ground levels will be raised as well. The two buildings D & E will dominate the park and in no way “tastefully ornament” the listed building.

(The recent growth of vegetation near the folly is a direct result of neglect on the part of the Council. Until recently the listed building has enjoyed a spacious green setting and this should have been and should be maintained.)

Drainage:

The excessive number of apartments and the bulk and massing of the buildings, particularly those on the lawn terraces, together with the steep slope of the internal road leading to the car park and raised ground levels will exacerbate the flood/drainage problems referred to in the latest drainage report. Planting a few small trees will in no way compensate for the large ones chopped down.

It would be hard to find a more obvious example of overdevelopment and unsustainable development than this.

EDDC isn’t like John Lewis (“Never knowingly undersold)!

Letter in today’s Sidmouth Herald:

Cllr Barlow rightly castigates the developers of the 36 Churchill homes for their measly offer towards affordable homes in the light of the profits likely to be made. How much more profit will PegasusLife make from 115 apartments at Knowle, but in this case without any payment at all towards affordable homes? What is more, EDDC have, I believe, “knowingly undersold” the site, including parts of the public park, to pay towards an unnecessary re-location, so that PegasusLife are likely, according to some estimates, to make a net profit of around £26 million. And because of the inadequate care to be provided, this development will very likely put great strain on already threatened local health services. Or does PegasusLife expect most of the apartments to become second homes for the extremely wealthy, as there is apparently nothing apart from cost to prevent this? Either way, is this what Sidmouth needs?

Readers may also like to know that, since they sent in their objections to the Knowle development, well over 50 new documents have been submitted by PegasusLife (in August and on 27 October). Some of these contradict earlier and misleading artist-impressions and show new details and changes including drainage problems upon which people may wish to comment. Comments should reach the planning department by November 11 as the application is likely to be put to the Development Management Committee on December 6.

Someone is in a hurry …. could an EDDC/PegasusLife deadline be nearing? And are these major or minor amendments? Major amendments need to go through the planninf process and DMC. Putting through major amendments as minor ones coyld give grounds for a judicial review …

The District Council has received more amendments to the Planning Application (ref 16/0872/MFUL) for Knowle. They consist of Pegasus Life’s revised drainage and bat mitigation reports, together with amendments to the design and footprint of building E and the associated landscaping.

DEADLINE for COMMENTS is FRIDAY 11th NOVEMBER, 2016.

The plans and Design Access Statement show (a) that Building E is moved very slightly north with planting around it (not a major change) and (b) Pegasus are arguing that the summerhouse is already shrouded in vegetation (how has this occurred?) and that views from the south will remain largely unaffected. The revised Drainage and Bat statements are lengthy, requiring close attention.

Whatever happened to … Knowle relocation costs?

Given that Exmouth’s regeneration plan costs have more than doubled from £1.5m to £3.2m (see below) and part of that cost is said to be the development costs rising, whatever happened to Knowle relocation costs?

First it was going to be cost neutral …
Then it was going to cost an extra £4 million …
The latest estimate (some time ago) had the extra cost at £9.7 million

Since then:

… labour costs have increased (minimum wage rise)
… skilled labour is less available (migrants choosing not to come or being sucked into Hinkley C, our older skilled workers retiring and not being replaced by youngsters with the required training due to skills gap)
… imported raw materials costs have risen enormously due to the falling pound
… Community Infrastructure Levy to be paid

Of course, EDDC could build prefab offices to keep down costs, just as the government intends to do with housing …

Suddenly Knowle looks much more attractive in that bright autumn sun, with its lovely park and the view of the sea …

Oh, wait … it’s been flogged off for luxury retirement housing.

Residents want clarification of Knowle housing designation

An EDDC spokesperson says it will be up to the DMC to decide classification but then says there are legal aspects to be considered.

The DMC are laypersons- surely they are not qualified to take such decisions?

“District chiefs have yet to decide how the use of a proposed 115-home retirement community at Knowle should be classified.

The Knowle Residents’ Association this week called for clarity on the matter. Householders say that, if the development ends up classed as ‘C3’ – housing – developer PegasusLife will need to either include ‘affordable’ homes on-site, or pay towards them.

If it is care accommodation [C2], the group says the development will be even further from the 50 homes the site is allocated in East Devon District Council’s (EDDC) Local Plan.

Residents’ association chairman Kelvin Dent said the group is ‘amazed’ the authority has not decided what use class the development falls into. He added: “Our view is that the application is akin to housing – albeit with the occupants of the proposed apartments being able to purchase a package of care to suit their needs.

“Under planning law, this equates to a C3 use and PegasusLife will be obliged to provide social housing as part of their development or to make a substantial financial contribution towards the social housing that Sidmouth desperately needs and support for the local community.

“We look forward to receiving confirmation from EDDC that they agree and will be helping local young people to find a home.”

A spokeswoman for EDDC – which intends to relocate from the Knowle HQ to Exmouth and Honiton – said officers had been working on the basis that the development’s use would be C2.

She added: “However, officers have been considering whether the form and layout of the proposed development and the manner in which it is proposed to operate would constitute a C2 use or not.

“In considering this issue, officers have been, and continue to consider, the views expressed by residents and relevant case-law.”

The spokeswoman said the officers’ conclusions on PegasusLife’s application will likely be presented to EDDC’s development management committee (DMC) on December 6. The agenda will be published 10 days beforehand.

She added: “Ultimately, a decision on this issue is for the members of DMC to make.”

Projected maintenance costs for relocation project

The ICO say EDDC don’t have to produce spreadsheets but have to publish the following re the new-build at Honiton:

“To disclose the price that the developer is prepared to pay for the land from the cash flow documents which the council withheld.”

The ‘Conclusions’ are interesting, however:

“53. There is a public interest in protecting the public purse, in this case this is balanced in this case against the public interest in allowing the public to scrutinise the council’s decisions and financial assumptions about the project to develop new offices for itself. This latter aspect clearly raises the level of transparency which would be expected as the council could be seen to be spending public money on its own facilities, for its own purposes. PM must publish secret papers about refusing Brexit vote in Parliament

“The government has been forced by a senior judge to reveal secret legal arguments for refusing to let parliament decide when and how the UK should withdraw from the European Union.

In a preliminary victory for those challenging Theresa May’s power to trigger Brexit, a high court judge, Mr Justice Cranston, has swept aside restrictions on publishing official documents before the hearing on 13 October.

In the released documents, lawyers for the government argue that it is “constitutionally impermissible” for parliament to be given the authority rather than the prime minister and dismiss any notion that the devolved nations – Scotland, Northern Ireland and Wales – will have any say in the process”.

They add: “The appropriate point at which the UK should begin the procedure required by article 50 [of the European Union treaty] to give effect to [notifying the UK’s exit] is a matter of high, if not the highest policy.

“It is a polycentric decision based upon a multitude of domestic and foreign policy and political concerns for which the expertise of ministers and their officials are particularly well-suited and the courts ill-suited.”

Responding to the release of the skeleton arguments, John Halford, a solicitor partner at Bindmans law firm which represents the People’s Challenge, a crowd-funded group, said: “The court’s order allows a floodlight to be shone on the government’s secret reasons for believing it alone can bring about Brexit without any meaningful parliamentary scrutiny.

“Those who were unsettled by the government’s insistence on its defence being kept secret will now be surprised by the contents, including submissions that Brexit has nothing constitutionally to do with the Scottish and Northern Ireland devolved governments, that parliament ‘clearly understood’ it was surrendering any role it might have in Brexit by passing the EU Referendum Act, that it has no control over making and withdrawal from treaties and that individuals can have fundamental rights conferred by acts of parliament stripped away if and when the executive withdraws from the treaties on which they are based.

“These arguments will be tested in court next month, but now they can be debated by the public too.”

and EDDC is one of a handful of councils that the ICO has taken to court (Knowle consultancy secrecy) where the ICO won its case and forced previously secret papers to be published.
