“Town councillors in Cranbrook have voiced their concerns over motorists travelling at speed on the town’s roads.

At a meeting last week, Councillor Matt Osborn said he saw vehicles using Court Royal – which runs from Cranberry Farm pub to Tillhouse Road – as a ‘drag strip’.

The problem of high speeds in Cranbrook has been further compounded by the fact police can only legally enforce a speed limit on an ‘adopted’ road.

No roads in Cranbrook have been adopted yet, meaning any police prosecutions for speeding offences would fail.

At a town council meeting last week, Cllr Ray Bloxham said: “The Road Traffic Act covers un-adopted roads, but the police do not see it that way.

“We have a dilemma and it has cropped up many times.

“Devon County Council (DCC) has set up a forum to tackle issues with speed because we are unhappy with the way speed is monitored.”

But chief inspector Adrian Leisk, head of roads policing, told the Herald that it was untrue that police were not enforcing the law in relation to the speed limit in Cranbrook – although it was a question of whether the law permitted them to do so.

He added: “To legally enforce a speed limit on a road, a valid and legal Traffic Regulation Order (TRO) needs to be produced and published.

“This will be done by the highway authority, which in this case will be Devon County Council, after the roads are formally handed over, or adopted.

“Any prosecutions for speeding offences will fail if the TRO is not valid or present. This will obviously be applicable after the road is adopted by the highway authority.”

Mr Leisk said the process of adoption ensured that the road was compliant with regulations, and all of the necessary design and technical specifications are met.

He added: “Prior to formal adoption, the responsibility for site safety rests with the developer, who still own the roads and are responsible for their upkeep.

“This should be risk assessed and addressed as all other safety considerations on a building site.

“This can include temporary measures to reduce residual speed on the site.

“Essentially, this road is not currently ‘in the hands of the police.’”

“Rural areas at risk of terminal decline warn council chiefs”

“Unaffordable housing, an ageing population unable to access health services, slow broadband and poorly skilled workers make for a deepening divide between town and country.

The threat is exposed in the interim report of the Post-Brexit England Commission set up by the Local Government Association to examine challenges faced by non-metropolitan England.

Young people are struggling to stay in rural communities where the average house price is £320,700 – £87,000 higher than the £233,600 average of urban areas, excluding London, the report said.

Rural firms grapple with patchy mobile and broadband connections which cuts off access to new markets.

Councillor Mark Hawthorne, chairman of the LGA’s People and Places Board, said: “Rural areas face a perfect storm.

“It is increasingly difficult for people to buy a home in their local community, mobile and broadband connectivity can be patchy.

“People living within rural and deeply rural communities face increasing isolation from health services. If Britain is to make the most of a successful future outside the EU, it’s essential our future success is not confined to our cities. Unless the Government can give non-metropolitan England the powers and resources it needs, it will be left behind.”

Tom Fyans, of the Campaign to Protect Rural England, said: “Affordable housing, public transport, high speed broadband and thriving rural economies are all interdependent.

“If our market towns and villages are to thrive once again we must make sure that rural communities are attractive places to live and prosper for people of all ages.”

Village Development Plan Approved by EDDC Strategic Planning Committee

The long-suffering residents of Farringdon and Woodbury Salterton are now one step closer from being a little more confidant with their fears of further growth from the Industrial Business Parks on their doorsteps from Hill Barton and Greendale Business Parks.

These 2 business parks have been growing at a considerable rate over the last 20 years which has provided important business opportunities and employment. However, it has been felt that further growth would be inappropriate in the open countryside some distance away from any major towns.

East Devon Local Plan proposals in the Local Plan approved in 2016 supported planned commercial growth would be at Cranbrook and areas close to Exeter together with other major towns in the district.

However there has been a number of challenges made to these policies with a number of Planning Inspectors hearings and High Court cases to these particular policies.

It was always known that the Local Plan would be challenged for development at these Business Parks and some villages. Therefore, the Local Authority proposed an additional planning document known as the “Villages Development Plan” which is an additional planning document drawn up by the Strategic Planning Department at East Devon which will provide further guidance and clarity to the largest villages in the district and the two business parks.

Finally, after 3 years of deliberation and public consultations, East Devon`s Strategic Planning Committee meeting this week, agreed to recommend to the East Devon`s Full Council meeting on the 25th of July that the “Villages Plan” be adopted.

The Villages Plan has been through several rounds of public consultation and the plan text has been refined to reflect the comments made.

Then followed a Planning Inspectors hearing plus an examination and recently returned by the Planning Inspector with an agreed approval following further changes and amendments.

The result of the Strategic Planning Committees approval and recommendation to the next Full Council meeting to adopt the new policy document will provide clarity and guidance on planning matters to the Villages and to the two Business Parks.

In the case of the Business Parks new planning policies are to be adopted.

Policy VP04 and VP05 which include a map that shows the extent of authorised uses at the Business Parks. Beyond the “Employment Area” shown on the map, any further planning applications will be considered to be in the “open countryside” and will be subject to stringent countryside protection policies.

It is therefore hoped by the rural villages of Farringdon and Woodbury Salterton that this endorsement of restricting further expansion at these Business Parks will provide clarity and certainty for the community for many years.

Violence in Cranbrook – two attacks, including one in park

“A teenage girl has spoke of the moment a grown mum swore at and attacked her and her 14-year-old friend – while a group of children watch on.

The shocking clash, filmed by an eyewitness and shared publicly to Facebook, happened at a park next to St Martin’s Primary School, Cranbrook, just before 10pm on Friday.

The heavily-built woman and her friends loudly challenge a group of teenagers, snapping selfies against that evening’s striking sunset, in front of what appears to be their own children.

A row breaks out and the woman, wearing a flower-patterned dress, walks toward the group and shoves a 14-year-old girl before appearing to slap Angel Robinson, 17, in her face.

The force of the blow sees her knees buckle, as the park erupts with shouting and swearing.

Angel’s mum Sheena Robinson is fuming over the assault on a daughter who “would not hurt a fly” and weighs only six stone.

Speaking with Devon Live, Angel and her mum spoke of their anger and upset over the shocking incident – filmed by her friend Dayna, also confronted in the footage.

Angel said: “Basically, we were up the park and there was a family drinking vodka and wine and getting really, really drunk. “While we were stood taking selfies one of them started shouting at us.

“Another woman then gobbed off and started on Dayna. Then she whacks the 14-year-old. I went in and then she hits me.”

Angel says that, luckily, the swipe did not leave a mark on her.

For Angel, it proves that teenagers aren’t necessarily the cause of anti-social behaviour in the East Devon town.

“You see all over [Facebook community page] Belonging To Cranbrook complaints about teenagers and that we are the problem.

“But these were grown women. The parents are just as bad as the teenagers.”

Angel and her mum say the family at the table are not known to them, and it had been the first time Angel had encountered them at the park.

She says the incident won’t put her off returning with her mates.

Sheena says Devon & Cornwall Police have been made aware of the footage and are looking into the incident.

It wasn’t the only fight to break out in Cranbrook that evening.

Police were called to an altercation between two men at Great Meadow at 6.45pm.

A row led to one of them being shoved into a bush.

Police are using CCTV to help their enquiries.”

Those who bothered to open what looked like junk mail discovered that part of the road had been sold to a private company and they would have to buy a £2.50-a-week permit to leave their cars outside their homes where free parking had been available for 50 years. Expansion of Cranbrook not going down well with – Cranbrook

“A total of 138 consultation responses were received from town and parish councils, councillors, specialist bodies, developers and the public. A wide range of issues were raised, including technical concerns about transport issues, such as problems providing vehicle access to some parts of the proposed expansion areas and how rail services can be improved to deliver a half hourly service into Exeter.

It was also noted that some additional land had been put forward by landowners for development through the consultation and this now had to be considered for inclusion in the plan.

… People were mainly concerned about the location and extent of development to the south of the London Road, particularly where this intrudes into Rockbeare parish and the Green wedge that was designated to prevent settlement coalescence (joining up) between Cranbrook and the village.

The community at Rockbeare raised strong concerns with these proposals, which also conflict with the emerging Rockbeare Neighbourhood Plan that has recently been out to consultation. Members were advised that this development was important for bringing the London Road into the town, as well as for creating a sense of place along the road as an entrance to Cranbrook….”

Risk of green wedge between Cranbrook and Rockbeare being swallowed up despite Local Plan rules

“Cllr Rob Longhurst said: “The main thing I would be concerned with is the idea that a green wedge could be disposed of if it doesn’t fit. It was put there for a reason after long debate and I think it is wrong to suddenly discard it as being inconvenient.”

Cllr Mark Williamson said: “It is so clear in the strategy of the Local Plan that it only takes up a single sentence, saying within green wedges, development will not be permitted. There are six green wedges in the Local Plan so if this was allowed then there will be sleepless nights around the district, where the other green wedges are, particularly around Seaton and Colyton.”

EDDC to borrow a minimum of £3.4 million and up to £8 million to “improve” Greater Exeter enterprise zone

Owl says: it seems western East Devon/Greater Exeter is to thrive at the expense of eastern East Devon; more of everything for Greater Exeter, less of everything for Lesser East Devon.

“Improved bus services, a new park-and-change car park, and improvements to Exeter Airport are all on the cards.

East Devon District Council’s Cabinet is being asked to approve borrowing of nearly £3.5m to help accelerate the projects in the Enterprise Zone.

The Exeter and East Devon Enterprise Zone consists of the Exeter Science Park, the Skypark, the Exeter Airport Business Park and Cranbrook Town Centre.

A report to the cabinet is seeking approval for £3,391,250m to be borrowed against future ring-fenced business rate income.

The report, that goes to the Cabinet on Wednesday, April 4, written by Naomi Harnett, Enterprise Zone Programme Manager, says: “While not yet fully developed and appraised it is considered that these projects are also likely to make a substantial contribution to the achievement of the objectives of the Enterprise Zone.

“The Enterprise Zone designation is a powerful means of accelerating the delivery of new commercial space and jobs in the four sites in the West End of the District.

“The more that can be done to accelerate the delivery of new commercial space the greater the impact there will be both in terms of business rate income and wider economic benefit. Work has focused on developing projects that help to overcome identified barriers to delivery and/or have a catalytic impact in terms of accelerating the pace of new commercial development.

“Approval is sought for the funding of an initial set of projects that are considered to contribute substantially to meeting the objectives for the EZ.”

The report seeks approval for £3,391,250m to be borrowed against future ring-fenced business rate income.

The four proposals that the council is being asked to invest in are:

1 – An enhanced frequency bus service (30 minute at peak) connecting Exeter to the Enterprise Zone area. This includes connections via the key transport nodes of Exeter St Davids and Exeter Airport. The service is due to commence at around 5am and run through to 11pm, with the intention that this fits with key shift patterns and flight times. Some of the services will also continue to Woodbury and Exmouth. The service builds on an existing service tendered by Devon County Council and the intention is to subsidise this for an initial period of 3 years starting from Summer 2018. The scheme would cost £536,250 and would be delivered by Devon County Council.

2 – A 309 space park-and-change car park located at the Exeter Science Park, alongside bike lockers and an e-bike docking station. The facility will both support the development of the Science Park and contribute to the wider transport strategy for the area. It is anticipated that the works will complete during summer 2019 and be delivered by Devon County Council, and would cost £2.4m

3 – An upgrade to the Exeter Airport Instrument Landing System. The current system installed in 1997 has now reached the point where there is no further operational tolerance to accommodate additional nearby development. Subsequently this is a significant barrier to development coming forward particularly at both Skypark and the Airport Business Park extension. The scheme would be delivered by Exeter Airport and cost £1.4m

4 – An upgrade to Long Lane, the road that runs immediately to the south of the airport. It is the principle means of access to the Airport Business Park extension and is sub-standard to the point where no further development can proceed until it is improved and is therefore a significant barrier to one of the four EZ sites coming forward. An initial sum of up to £100,000 is sought in order to complete the scheme design and would be delivered by Devon County Council.

The investment in the enhanced bus service and park and change facility would be in the form of a grant, and a forward funding mechanism is proposed to secure the timely upgrading of the Instrument Landing Systems at the Airport. The costs of this can then be recouped as development proceeds.

The report also request that the cabinet agrees the principle of borrowing up to £8m against ringfenced business rate income to fund the delivery of projects and makes this recommendation to Council

Further papers setting out specific investment proposals in relation Cranbrook town centre and Exeter Airport would come to the Cabinet at a later date.

Help-to-buy: now the crunch comes (for some)

Help-to-buy gave interest-free loans of 20% of new house value (40% in London) for 5 years. After that, loan repayment (currently 1.75%) kicks in. That 20% or 40% of home value is still owned by the government and any increase in the home’s value results in increased charges at the year 5 point. Early adopters of this scheme are now reaching this 5 year point. The government’s loan repayments will be in addition to mortgage payments and will rise with the cost of living (and at the same time many mortgage rates may rise if or when the bank rate increases).

Some buyers who have seen big gains in property value may be able to trade up and pay off the loan, but anyone who has seen static value or even a fall (many new houses were over-priced) will be in trouble.

Those whose homes have not increased in value face “a ticking time bomb” according to the think-tank Resolution Foundation.

Wonder how Cranbrook residents who took advantage of the scheme feel now?

And was this consequence foreseen by government or borrowers?

Cranbrook will grow to 8,000 homes over 15 years

Owl says: and still it has no town centre and developers refuse to fund one!

“Feedback on how Devon’s newest town, Cranbrook, should grow and develop over the next 15 years, goes before councillors next week.

The Cranbrook Plan: Preferred Approach’ document sets out how the growth of the town up to around 8,000 households over the next 15 years will be achieved.

A community consultation ran for eight weeks from mid-November last year to early January and it gave residents of Cranbrook and its neighbouring communities the opportunity to comment on the proposals for the future of the town contained within the document ‘Cranbrook Plan: Preferred Approach’.

In addition to identifying land for new houses, the document also identified land for sport and community, economy and enterprise, schools, allotments and Gypsy and Travellers pitches. …

Outline planning permission for the first 2,900 homes at Cranbrook was issued in October 2010 followed shortly by the reserved matters for the first 1,100 homes in April 2011. Today there are approximately 1,700 households living at Cranbrook, equivalent to a population of around 4,000 people, but the Local Plan anticipates Cranbrook comprising approximately 7,850 new homes by 2031. This equates to a population of around 20,000 people meaning that Cranbrook will have quickly expanded to become the second largest town in the District.

The consultation revealed that there is a concern over relationship with properties at Broadclyst Station, who are keen to retain a separate identity, that the East Devon New Community partners say that the Treasbeare area could accommodate a minimum of 1,000 dwellings as opposed to the 800-950 stated in the masterplan, and that there should be a school in both of the Bluehayes and the Treasbeare area of Cranbrook..

On transport issues, the responses reveal that the delivery of a half-hourly rail service is a key ambition of the plan in order to encourage use of rail travel as an alternative to the car, but that despite the wishes of residents for the old A30, the B3174 London Road to remain as a bypass to developed, it is scheduled to be downgraded from its current status and to become an integral part of the town. …”

MPs profess shock at £817 million housing underspend

Owl says: Let’s say each affordable home cost a very generous £200,000 – that’s just over 4,000 affordable homes! If we went down the prefabricated route and homes were £100,000 that’s just over 8,000. Cranbrook currently has about 3,500 homes. Scandalous.

“MPs are demanding an urgent explanation from ministers after being told that £817m allocated for desperately needed affordable housing and other projects in cash-strapped local authorities has been returned to the Treasury unspent.

The surrender of the unused cash has astonished members of the cross-party housing, communities and local government select committee at a time when Theresa May has insisted housebuilding is a top priority and when many local authorities are becoming mired in ever deeper financial crises.

On Monday the committee, which discovered the underspend for 2017-18, will interrogate housing minister Dominic Raab and homelessness minister Heather Wheeler on the issue, before Tuesday’s spring statement by the chancellor, Philip Hammond. He is under heavy pressure from MPs, and the Tory-controlled Local Government Association, to signal extra help for the local authority sector, which has seen budget cuts of around 50% since 2010.

The acting chair of the committee, the Tory MP Bob Blackman, said: “We will be wanting to know why this very large sum has not been spent at a time of great strain on local authority budgets, and why it was not channelled to other spending projects. It does not help those of us who argue that more should be given to local authorities if the chancellor knows money he gave last time has not even been spent.” MPs believe they can argue for more for local authorities because Hammond will announce that unexpectedly high tax receipts have left the Treasury with a windfall of between £7bn and £10bn.

Speaking on Saturday night, the chancellor said the government had gone a long way to put the public finances back in order and was now able to pump more into services, including housing: “We’re making good progress on building the homes this country needs with, last year, a 20-year record high for housebuilding. This is how we build an economy that works for everyone.”

But Helen Hayes MP, a Labour member of the select committee, said it was “astonishing” that money was lying unspent when the number of social homes built by local authorities from government grants had dropped dramatically since 2010. “This is the biggest issue for families up and down the country, including in my Dulwich and West Norwood constituency,” she said. “It is simply astonishing and unacceptable that there is so little urgency being shown.”

For the last 30 years, councils have cut back council housebuilding in the face of severe budget cuts. Local authorities have also been discouraged from building by the government’s “right to buy” scheme, which allows tenants to buy council properties at a 40% discount.

Hundreds of councils have set up their own property development companies to build homes and get around the rules. But progress has been slow, in part because of the threat from ministers that they might extend the right to buy to the new council-owned companies.

Shadow housing minister John Healey said housing and local government secretary Sajid Javid’s department had also failed to spend £220m of funding allocated to affordable housing last year. “Sajid Javid needs to explain why he is selling families short by surrendering much-needed cash for new homes,” he said.“If the secretary of state can’t defend his department’s budget from the Treasury he should give the job to someone who can.”

A housing ministry spokesman said: “We are investing £9bn in affordable homes, including £2bn to help councils and housing associations build social rent homes where they are most needed.

“All of the affordable housing underspend from 2016-17, including £65m returned by the Greater London Authority, has been made available to spend on similar schemes.”

Last week, the National Audit Office estimated that 10% of unitary authorities and county councils have less than three years’ reserves left if they continue to deploy them at current rates, leaving them vulnerable to potential insolvency.

The Tory chair of the health and social care select committee, Sarah Wollaston, said action was needed urgently: “NHS public health and social care need a boost now, but also a long-term plan to provide the funding they need and a clear plan to set out how the money will be raised.”

Labour will counter Hammond’s claim that the public finances are on the mend by calling for an emergency budget to address the funding crisis hitting Tory- as well as Labour- and Lib Dem-run councils.”

Cranbrook problems continue

According to this month’s Cranbrook Herald:

People are up in arms about the estate rent charges, already extensively reported by Owl.

Town councillors say young people are consuming too many energy drinks and, as a result, are “off the wall” on caffeine.  They are pressurising the Co-op to put a lower age limit on purchase of the drinks.

Cranbrook will have its own district councillors in elections in May 2019 – three of them – perhaps they will be able to plead their case to EDDC..

Residents worry about the visual impact of extending Cranbrook to the south as well as to the north.

Cranbrook Herald reports on estate rent charges

Now Cranbrook Herald has taken it up:

“The unexpected demand for payment caused uproar on social media, distressing many during the festive break.

One resident said the company which sent the letter was using ‘scare-mongering tactics’.

Another said the matter was a ‘disgrace’.

The estate and asset management company Blenheims sent the bill on behalf of the Cranbrook Consortium and FPCR (which provides the town’s landscape and horicultural services).

In the letter – delivered to all Cranbrook households on Friday, December 22 – Blenheims explained that the annual Estate Rent Charge (ERC), which meets the cost of maintaining the public open spaces and amenity areas had been reviewed.

Previously set at £150 per annum – based on an ‘historic and initial assessment of the annual costs’ – the Consortium had increased the ERC to £231.76, to reflect actual accounting figures. These suggested that the total costs of the 2017-18 ERC were £370,816. Split between 1,600 properties, this came to £231.76 per household.

In many cases, the £231.76 demand was reduced to £194.26, taking into account an initial quarterly ERC instalment paid by residents of £37.50.

The letter implied that the £194.26 needed to be paid in one sum. There was also confusion about when the money needed to be paid, with some residents believing it had to be within 10 working days.

There was no suggestion of being able to pay in instalments (although Blenheims has since said that there are three payment dates – January 22, February 1 and March 1).

Having received their bills, Cranbrook residents found Blenheims had shut for Christmas, and initially there was no one available to discuss the issue.

At the request of Cranbrook Town Council (CTC), the Reverend Lythan Nevard – Cranbrook’s minister and a Belonging to Cranbrook Facebook moderator – offered advice for residents, posting her thoughts on social media.

On January 2, CTC posted its own advice on its website, describing the timing of the letter as ‘unfortunate’, and Blenheims has since issued a ‘frequently asked questions’ (FAQ) document.

“I think the timing of the Blenheims’ letter was poor at best,” said a Cranbrook resident, who did not wish to be named. “Some people were concerned that if they just cancelled their direct debits, they would end up with bailiffs at their door after Christmas.”

“It was a disgrace to receive a letter demanding payment of £231.76 within ten days, and especially at this time of the year,” said another resident.

In its FAQ to residents, Blenheims said the payment demand was issued on December 22 in advance of the next collection date, December 25, and was ‘in accordance’ with residents’ ERC deed.

It also issued advice for those that had cancelled their direct debit or hadn’t returned their mandate and explained why the ERC was being increased and why residents – who are already paying council tax – were being charged for ERC.

Neither Blenheims nor the Consortium have provided the Herald with further comment on this matter.

CTC is currently finalising details of taking over the town’s ERC. If draft agreements are approved, from April 6, 2018, the ERC will be paid as part of EDDC’s council tax, with any increase in the element of the council tax payable to CTC.”

Wain Homes (55 properties) and Cavanna Homes (19 properties) have their own Estate Rent Charge which will remain in place but they will pay the higher CTC precept

The Town Council had indicated a willingness in principle to take on the public open space on both sites. Wain Homes remain subject to enforcement because of failure to complete the public open space and we met with them in the summer of 2017 to discuss this.

If they complete the work CTC could adopt the public open space. Hopefully local residents on the site will press Wain Homes to do this.

Cavanna have passed their public open space to a management company but undertook to have talks to have the public open space transferred back so that CTC could adopt it. In both cases the ball is in the developers’ court.”

Cranbrook residents very unhappy about estate rent charge bills

Basically a total mess with large annual bills hitting residents just before Christmas. Many residents dispute work and charges.

And this is interesting:

EDDC has consistently taken the line that it will not take on responsibility for anything other than its statutory responsibilities and this is not unique to Cranbrook but affecting all other new major developments.
On the face of it this is unfair – Cranbrook residents contribute to all public open space owned by EDDC but the reverse is not the case.

This is why the Town Council is seeking to take on these responsibilities to provide best value for residents of the Town.

It is for EDDC to respond to this point.”
