Bovis Homes, one of Britain’s biggest housebuilders, faces a potential class-action lawsuit from a group of buyers who accuse it of selling houses riddled with defects.

Puneet Verma bought a five-bedroom house with his wife for £485,000 in Milton Keynes two years ago but says he still has a list of 120 snags. He is now consulting two law firms, Leigh Day and Slater & Gordon, about taking group action.

“I have had a survey done by a chartered surveyor that categorically states the workmanship is extremely poor and that Bovis is not in compliance with building regulations,” Verma says. “Bovis has treated, and continues to treat, its customers appallingly and now the only way to get our problems resolved is to take legal action.”

Verma is aiming to raise a £100,000 fund through a £100 contribution per homeowner, assuming 1,000 of the 2,500-strong Bovis Homes Victims group on Facebook sign up.

It has been almost a year since the housebuilder issued a profit warning and was accused of paying thousands of pounds in cash incentives to get buyers to move into unfinished homes. As the scandal widened, the company set aside £7m to fix defects and appointed a new chief executive.

A year on, some Bovis homeowners say they will be spending Christmas in houses that are riddled with faults, including leaks, moving and creaking floors, lack of insulation and sewage backups, as well coping with shoddy workmanship.

Ian Tyler, the chairman of Bovis, apologised to buyers in May for “letting them down” and admitted the firm had been cutting corners to hit ambitious targets. The company says it slowed production to iron out build problems, retrained sales staff and set up an advisory homebuyers panel, which has met once.

Dave Howard, who set up the Facebook group with his wife, Ann, and who sits on the panel, doubts whether Bovis has made any progress on improving build standards and customer service. He claims homeowners who report problems are being referred to the National House Building Council (NHBC), the standard-setting body and main home construction warranty provider for new-builds in the UK. But in the first two years after purchase the housebuilder is responsible for rectifying defects.

“We have had constructive contact with the new customer experience director, but there are too many people hitting brick walls with Bovis and NHBC,” Howard says. “Some new customers have had better experiences but that seems to have slipped too.”

Bovis says: “We have made significant changes to how we operate in 2017 and a growing majority of our customers would now recommend us to family and friends.

“We remain determined to make things right for customers who raise warranty items and apologise to those to whom we have not previously delivered the high levels of quality and service they rightly expected.” …”

Pete Oldham and his wife, a retired couple, bought a three-bedroom semi-detached house in Cranbrook, Devon, for £234,995 in December 2015. “All the floors move,” Oldham says. “When you walk into a room the furniture moves. They haven’t fitted things properly but are in denial.” He says the floor joists should be 400mm apart, not 600mm. There has been a breakdown in communication with Bovis and he has been referred to NHBC.”

“The UK’s competition regulator has announced that it is launching a comprehensive study into domestic heat networks to make sure that households are getting a good deal.

Competition and Markets Authority on Thursday said that heat networks – systems that heat multiple homes from one central source – currently supply about half a million UK homes through about 17,000 networks.

Between now and 2030, the number of customers using heat networks is expected to grow significantly to around 20 per cent of all households. But the sector is not currently subject to the same regulation as other forms of energy supply such as mains gas and electricity.

The CMA said that, as a result of that, it’s concerned that many customers, a large proportion of whom live in social housing, may be unable to easily switch suppliers or are locked into very long contracts – some for up to 25 years.

There’s a risk, the regulator said, that they may be paying too much or receiving a poor quality of service.

It said that its study into the networks would examine whether customers are aware of the costs of heat networks both before and after moving into a property and whether heat networks are natural monopolies. It would also look at the prices, service quality and reliability of heat networks.

“Heat networks can play an important role in cutting carbon and keeping down energy bills for customers. However, we have concerns that this sector may not be working as well as it could be for the half a million homes heated by these systems now and the millions that may be connected in the future,” said Andrea Coscelli, chief executive of the CMA.

“That is why we’re taking a closer look at this market to ensure that heat network customers get a good deal on their energy now and in the future.”

The CMA study will be completed within the next 12 months. It said that it would source evidence from a wide range of stakeholders, including heat network builders and operators, other government departments, local authorities, sector regulators and consumer groups.

An interim report updating on the CMA’s progress will be published in six months.

Heating networks can be better for the environment because they deliver lower carbon emissions, which can also result in cost benefits for households.

Because of this, heat networks have become an important part of the Government’s strategy to reduce carbon and cut heating bills.”

Another new-build developer scam

Estate rent charges apply in Cranbrook:

Thousands of homeowners on private estates are facing unregulated and uncapped maintenance fees, amid allegations that developers have created a cash cow from charging for communal areas not maintained by the council.

Management contracts for “unadopted” private estates are frequently sold off to speculators and property management companies in the same way as freeholds and ground rents – leaving homeowners with spiralling fees and nowhere to turn.

If a new-build estate is “unadopted” it means communal areas such as roads, grass verges, pavements and playgrounds are retained by the developer. The developer then usually sub-contracts day-to-day management.

These companies then pass on the costs to homeowners (both freeholders and leaseholders) via a deed of transfer which obliges the homeowner, under the Law of Property Act 1925, to pay for maintenance of this land. This is often referred to as an “estate charge” or “service charge”. These are on top of full council tax – even though the council doesn’t maintain their street.

Critics say the system is open to abuse because management companies have no obligation to keep costs down or provide evidence the services they charge for are being carried out. Buyers may find the bills spiral as soon as a management contract is sold on.

Lynn Myers bought her two-bed leasehold house in Penrith, Cumbria, from developers Persimmon in September 2016. The sales agent told her the estate would be managed by Carleton Meadows Management Company with an estate charge of £100 a year per household for grass cutting.

When Gateway Property Management took over in July 2017 it tripled the fee to £308 a year – that’s £17,000 from the 55 residents. Myers alleges that the fee includes more than £3,000 “postage”.

“I am on a lower-end income and ploughed my late husband’s insurance money into this property,” says Myers. “I worry that I will be unable to afford this on top of full council tax etc, and also I will be unable to sell. I have been mis-led by Persimmon and the government.”

Persimmon says the initial costs had been miscalculated and that it was working with Gateway to resolve the issue.

Meanwhile, 40 miles away across the Lake District, residents in Church Meadows in Great Broughton are in a similar situation. Richard Elsworth moved into his Persimmon-built freehold property in May 2013. The estate’s 58 residents each pay Gateway a service charge of £125.53 a year, amounting to £7,281 to maintain about 600 square metres of grass.

But Gateway’s charges don’t stop there. When Elsworth’s neighbours sold their home, they were charged £360 for a “management pack” for the buyer, plus £144 for a deed of covenant.

“The only part of the pack that is relevant to the sale is a financial statement so that the service charge information is available to the prospective buyer. As the properties are freehold, Gateway has no responsibility whatsoever for the conveyancing process, other than to receive a deed of covenant from the conveyancing solicitors,” says Elsworth.

Gateway claims it provided an “often exhaustive” amount of information to purchasers’ solicitors when a sale takes place. It said it was common practice for managing agents to charge fees for sales packs and additional legal documentation. It says: “The information we are asked to provide varies from development to development and this is reflected in the amount we charge ranging from £150-£300 plus VAT.

“It is best-practice for the information to be prepared by professionally qualified staff because purchasers are reliant on information being accurate to enable the sale to proceed as smoothly as possible. Typically, a sales pack contains in excess of 25 pages and is tailored to the development.”

Privates estates were debated in parliament earlier this month. Kelly Tolhurst, Conservative MP for Rochester and Strood in Kent, told MPs how homeowners in Hoo bought from Taylor Wimpey and Bellway but are now in dispute with their property management company, SDL Bigwood.

Tolhurst went on to criticise Hyde Housing Association, and London and Quadrant. The latter tried to charge residents at Lodge Hill, Chattenden, for street lamps and street cleaning undertaken by Medway Council.

The Homeowners’ Rights Network (Hornets) is the campaign group fighting for a fairer deal for homeowners on private estates. Its main issue is a lack of a cap on charges and that homeowners don’t have a choice of provider. And, if homeowners have a dispute, there’s no resolution service in place.

Cathy Priestley, spokesperson for Hornets and a freeholder on a private estate, says the private estate model seems to be the norm for new-build estates. “We can only speculate as to why this has happened. The main benefactors are the plc developers who get to keep the estate land, don’t have to prepare it to adoption standards and don’t have to pay for its maintenance or the commuted sums for adoption,” she says. “All councils have to do, under planning, is to ensure there is a long-term sustainable arrangement to maintain the land (under the Town and Country Planning Act). They seem to readily accept assurances from the developers that the management company will deliver this. They don’t appear to have thought about how this affects homeowners.”

While leasehold owners have some (albeit limited) statutory protection, freeholders have very few options. They can take cases to court, but this can be expensive and time consuming. If they decide to simply not pay, they can ultimately lose their home. “Any arrears will normally be recoverable as a debt claim in the county court.

“However, homeowners should be cautious as the rent charge owner may have a number of options including the ability to take possession of the property,” says Adrian McClinton, associate solicitor at Coffin Mew.”

“I went to park at the train station this morning and a car had got stuck trying to gain access to the parking area … Most of the cars were parked OUTSIDE the designated area due to the fact that the entry with those barriers is TOOOO narrow ..What a waste of money ..

A bit like many Cranbrook garages, where the passenger has to get out before the driver goes in as they are so narrow, or those roads that are too narrow so cars park half-on the pavement – a problem for years as this article from 2013 illustrates:

“It’s a sore subject with a lot of people,” she says. “The builders park everywhere, taking up a lot of parking spaces. They park in front of people’s drives, sometimes they just park their vehicles right on the pavement, so you’re forced out into the road.”

Local residents have also started parking on the pavement, because the roads – especially the side streets, such as Mayfield Way, Henry’s Run and Mead Cross – are narrow. …

The police are concerned about poor car parking in Cranbrook.

“Some of the parking is fairly bad,” says Cranbrook’s Police Community Support Officer Jack Stannard. “If it’s horrendous, then I go and speak to the owner of the vehicle.”

The local police has also posted a Think Before You Park flier on a Cranbrook Facebook page, flagging up that ‘sensible parking could save a life’.

The fire service is also concerned.

“We have been visiting the area and working with the community to ensure there is adequate access for all emergency service vehicles,” says a spokesman. “When we see a vehicle that might cause an obstruction, we are either speaking to the driver direct or leaving a polite notice.

“It is everyone’s responsibility to ensure that emergency vehicles are not delayed getting to incidents.”

“Exeter would need to build houses more than twice as fast if it wanted to keep up with population growth.

The number of homes being built in the area actually dropped last year, the latest figures show – and housing is growing at a far slower
rate than the booming population.

… Government data reveals 450 homes were built in Exeter in 2016-17 – down from 651 the year before – bringing the total number of houses and flats to around 53,930.

That works out as a growth in Exeter housing of 0.84 per cent in the last year.

In comparison, the population of the area grew by nearly 2,500 people between mid-2015 and mid-2016 – the latest data available.

It means only one new home is being built for every six extra people in the area.

Population growth in Exeter is fuelled by both ‘natural’ factors – more births than deaths – as well as immigration from other parts of
the UK and abroad.

Thanks to this there are now nearly 130,000 people living in Exeter – a growth of 1.96 per cent in a single year.

It means the population in the area is growing more than twice as fast as homes are being built – one of the worst discrepancies seen in the
whole of England.

Across the country, rates of house building have actually overtaken total population growth in the last year, with the number of homes in
England increasing by more than 217,000 in 2016-17.

That brings the total number of dwellings in the country to around 24 million – up by 0.92 per cent on the year before. …”

Taylor Wimpey’s Facebook page has some VERY unflattering comments about their houses in Cranbrook, and Cranbrook itself – poor construction, parking problems, not enough shops, no 1 bed properties, size of rooms disputed, checks not made, repairs not done …

Oh dear.

Cranbrook attempts to rid itself of the developers’ “estate rent charge”

Cranbrook’s estate rent charge – currently around £150 per year per household – may be scrapped if plans by Cranbrook Town Council (CTC) go ahead.

If approved, the annual charge – for the management of Cranbrook’s public spaces, including play areas and the Country Park – would be replaced next April by an increase in CTC’s element of the East Devon District Council (EDDC) council tax bill.

But the increase won’t be a flat rate.

It would be a banded charge, depending on the rateable value of a property.

However, CTC believes its proposal will save people money. The council says that ‘considerable’ savings would be achieved by ‘cutting out’ expensive collection, legal and administration costs, removing management layers and being able to negotiate maintenance contracts.

In addition, all households in Cranbrook would contribute towards the maintenance of facilities within the town’s boundaries, whereas at present the estate rent charge is limited to those who purchase homes from the main consortium of developers.

“This is a significant step for the town,” said Cllr Kevin Blakey, CTC’s chairman. “The estate rent charge has been a continual source of concern for residents with the threat that the management company may seek to collect substantial back-payments and also raise charges without any apparent checks and balances.

“Some residents may feel this change is unfair, but based on the savings which the town council can make and the fact that we feel that it is fairer for all households to contribute to the maintenance of public amenities and facilities, we believe this is the right thing to do.

“It also provides an opportunity for those less able to pay to apply the current arrangements for council tax relief.

The developers and CTC are keen to reach an agreement.

Cllr Kevin Blakey said: “Both parties are working on the basis that the agreement would provide a clean break between the current estate rent charge position and the future. The town council wants to take control of the estate rent charge, once and for all.”

Cranbrook favoured over rural areas for bus services

Yet another blow for rural towns and villages where bus servicex have been cut so people can’t get into Exeter or the Science Park or the Lidl depot if they don’t have cars.

Bus operator Stagecoach has announced additional journeys on one of its popular routes.

The changes, which will be implemented on its 4 route on October 16, include a new 5.36am journey from Exeter Bus Station to Cranbrook running seven days a week.

The return journey to the bus station from Cranbrook will leave at 6.09am.

The route will also provide a later bus to and from Cranbrook on Sundays.

Under the revised changes, the last service from Exeter Bus Station to Cranbrook will be at 9.36pm and the last service from Cranbrook to Exeter Bus Station will be at 10.09pm.

The full 4 route runs from Exeter to Axminster, stopping at Cranbrook, Ottery St Mary and Honiton along the way.”

Owners of new homes are living on potholed roads with no street lights or rubbish collection as housebuilders and councils shun the responsibility for road maintenance.

Developers can save thousands by dodging the legal agreements that pass the roads on to local authority control, allowing builders to make roads narrower than usual, for example, and leaving homeowners to pay for the road’s upkeep or see it fall into disrepair.

People living on these unadopted streets have been forced to seek approval from road management committees before selling their homes and say it is harder to find buyers.

The government is to ban new houses from being sold on a leasehold basis to tackle onerous ground rent charges, yet owners of freehold houses on unadopted streets are being “held to ransom” by management companies that charge households up to £660 a year for road maintenance.

“We seem to be rewriting the rules on the way that roads are looked after,” says Derrick Chester, a councillor for Littlehampton and Arun in West Sussex.

Normally housebuilders have new roads “adopted” by the local authority through a legal agreement under Section 38 of the Highways Act 1980, while the sewers underneath are covered by a similar Section 104 arrangement. When the road is left unadopted, homeowners on the road are responsible for its upkeep, and often the sewers and facilities such as playgrounds and parks.

Halima Ali, 30, and her husband bought their freehold four-bedroom home in Rochdale, Greater Manchester, from Persimmon, the developer, and believed that the road would later be adopted by the local council. Seven years later the streets around the 120 flats and houses remain unadopted and are deteriorating.

“The street lights have not been fixed for years, so there are areas that are in complete darkness; it is quite scary at night. A neighbour has had a problem with a sewer cover, which is in danger of collapse,” she says. “There is a children’s playground and, even though it is a public park, residents are required to maintain it. The public come and trash it and we can be made to pay for its maintenance, which is outrageous, and we are paying council tax on top.”

Another homeowner, 56, bought a three-bedroom freehold house in Kettering, Northamptonshire, from SDC Builders nine years ago. “At the time it was sold to me as a benefit, your own private neighbourhood, which would be passed into the residents’ control once the developer had left,” she says, “but, as an unadopted road, we have no street lighting, the bin men won’t come down and we are liable if anyone has an accident on the communal land.”

She has been trying to sell her home, but buyers pulled out when they found out about problems with the unadopted road.

She says that SDC Builders set up a limited company for managing the development, which was passed to residents, who elected two neighbours as directors. She was not aware that if she wanted to sell her property it would require the directors’ approval, and they have refused permission over what she says is a trivial disagreement about parking.

Christine Hereward, the head of planning at Pemberton Greenish, the law firm, says councils and highways authorities will only adopt roads if they are built to their standards. Section 38 agreements are also backed by a lump sum, sometimes running to hundreds of thousands of pounds, put down by the housing developer as a bond against the road not being finished properly. Developers receive their bond back only when the road is adopted. Ms Ali says: “Persimmon has not built our road to the required standard. The council won’t adopt it.”

Critics say developers are choosing not to enter into a section 38 agreement so that they can bypass local authority standards; roads can be narrower and car parking spaces smaller than regulations require, for example. They also save tens of thousands by not making the required bond payments.

In 2009 the government estimated that it would cost £3 billion to bring the country’s thousands of unadopted streets up to an adoptable standard. “Developers can achieve cost savings and make their lives easier. It does enable them to construct a substandard highway. It is a shortcut. To be fair to the developers, it is up to councils to enforce the standards,” says a source who did not want to be named. “There is very little sanction.”

Mr Chester says councils and housebuilders are colluding over the issue because it saves both parties money. “It fits into the narrative about local authority budget cuts,” he says.

Phil Waller, a former construction manager who runs the website Brand-newhomes.co.uk, says: “I know of one development where a fire engine was unable to access a fire because of parked cars and the layout of the road.”

Unlike private roads, which are often gated, unadopted roads appear as ordinary streets. Whether the public has right of way can be uncertain. Mark Loveday, a barrister from Tanfield Chambers in London, says he frequently hears from homeowners who did not realise that their property was on an unadopted road. “What very often happens is nothing is done to the road for many years and it is only when potholes appear and someone living on the road says, ‘hang on, someone should be maintaining this road’”, he says.

Buyers of new-build homes ought to check the specifics of the road before the sale. “This is an important thing that should be flagged up by the solicitor,” says Mr Loveday. Those who are unsure about the status of their road can apply to the Land Registry for details.

Steve Turner of the Home Builders Federation, the trade association, says housebuilders are increasingly in dispute with local authorities and planning departments over the specifications of newly built roads, which is causing delays in local authorities adopting them. “The resolution typically involves the authority demanding more cash,” he says.

‘We may have to pay for the road upgrade’

Residents of unadopted streets often need to take out public liability insurance in case someone is injured on the street.

Keith Beattie used the government’s flagship Help to Buy scheme to buy his house in Haydock, near St Helens, Merseyside, from Westby Homes North West. In February 2014, when he moved in, the road was unfinished, with tarmac not properly laid and potholes filling up with water. The housebuilder went into administration in August. “The administrators have informed us that they won’t be completing the road and paths. St Helens council will not enter a section 38 until the road is brought to an adoptable standard, which it is not,” he says. “As residents, we may have to pay to have the road completed to the council’s standard.”

Gushing praise for Cranbrook – by someone who appears never to have lived there and seems to have relocated from Devon to London.

It reads to Owl to read like a (not-very-good) essay submitted for the digital journalism course the author has gone to London to study, rather than a well-researched article. Not a quality piece of Guardian journalism or a persuasive testament to the town, with quotes from one resident and the town clerk!

You’ll be easily forgiven if you haven’t heard of Cranbrook, because five years ago this east Devon town was the fields that cornered the historical city of Exeter. Creating this new town has been one of the few attempts to address a national homelessness crisis, now affecting more than 50,000 households across England. Cranbrook is the first new settlement to be developed in Devon since the middle ages.

I grew up in Exeter, watching it blossom from a modest city into a vibrant hub. I’m proud to say that I have come from the liberal bastion of the south-west: it was one of only three constituencies in the region to vote remain, and has long been a Labour stronghold. However, nimbyism has intensified over fears around an “invasion of outsiders”, and of local services becoming overburdened. Cranbrook has felt the brunt of this, with locals demanding that more housing is built – but “not in my backyard”.

The new town has even been branded as a magnet for unruly northerners and the crime capital of the south-west, renamed by some as “Crimebrook”, even though this is not borne out by police statistics. I remember such hostility circulating even before the first brick had been laid. Listeners to The Archers will be all too familiar with this depressing scenario: one current storyline includes growing opposition in Ambridge against the Bridge Farm housing development. Only Emma and Ed Grundy are in favour, it seems. How else can they hope to get a step on the housing ladder?

These nimbys, in real life, deepen the sense of otherness towards not only outsiders, but also to locals like myself who have been priced out of Exeter. The first phase of Cranbrook consisted of 1,120 homes, 40% of which were for social and affordable housing. Of the social housing available, 65% went to applicants with a local connection to east Devon, the other 35% going to local people in Exeter. The town has also received a £20m government investment, which has increased the development of social houses to 500 a year, accelerating Cranbrook’s ambition of expanding to 8,000 homes within the next decade or so.

Drawn to its location and lower house prices, Jacqui Issacs relocated her family to Cranbrook from Oxfordshire three years ago. “I find a much better sense of community here than I ever did in an established village,” she says. A report released earlier this year by the Devon & Cornwall police on the top crime hotspots within the county placed two of Exeter’s streets third and fourth, with one of Cranbrook’s streets ranked seventh. Issacs remarks: “I have never lived somewhere with so much within walking distance – the shops, the country park, pub and so on.”

Unlike the feudal Disneyland of Prince Charles’s Poundbury in nearby Dorset, Cranbrook has no experimental aesthetic. Nimbys see the town as soulless, but it just needs to be lived in a bit more: Issacs is looking forward to “having our own high street one day”. As the town clerk, Janine Gardner, says, Cranbrook is “not to be seen merely as an extension of the nearby Exeter”. The 3,000 Cranbrook residents already have their own doctors, schools, shops and leisure centre. And the town is uniquely youthful, with a high percentage of 24 to 35-year-olds, who can propel such developments.

I now live in the multicultural mecca of London, and feel that Cranbrook could provide a much-needed point of diversity if given the chance. While it is important for the town to build valuable bridges with Exeter, outsiders should be welcomed as enhancing the existing cultural fabric, not unpicking it.

With average house prices almost seven times people’s incomes, becoming a homeowner, especially for people of my generation, is increasingly a fantasy, even in Devon. Cranbrook is an opportunity not only to find a house, but also for us to make a home.

Rome wasn’t built in a day, and Cranbrook has only just put down its foundations: the nimbys just need to give it the time to build itself up.

Government and developers creating NIMBYs

“The biggest housebuilders are creating growing numbers of nimbys by trampling over communities and building ugly, unaffordable homes, the head of a homelessness charity has warned.

Polly Neate, the chief executive of Shelter, said that developers were putting profits before people and ignoring concerns about the quality and price of new homes.

She blamed the builders for “a huge loss of public faith in our housebuilding system” and called for reforms to planning laws to put people’s needs before corporate profits. “Even when communities create detailed plans for housing developments, these developers brush them aside and build unattractive, unaffordable homes,” she said. “This means many [people] choose to oppose new homes rather than go through a long planning process, only to be ignored in the end.”

The three biggest housebuilders, Persimmon, Taylor Wimpey and Barratt Developments, completed more than 46,000 homes last year and shared revenues of more than £11 billion. They made profits of £2.2 billion.

“The government needs to bring in a new way of building homes which listens to local people to build the high quality and genuinely affordable homes they need, along with schools, parks and other amenities,” Ms Neate said. “We once had a proud tradition of housebuilding in this country, as seen in our popular postwar new towns and garden cities, and it is now critical this is revived for the 21st century.”

Her comments came after a survey of more than 3,500 people found that only 13 per cent felt that developers listened to them. Almost 60 per cent said that they would be more inclined to support the building of new homes if they were listened to more keenly. The southeast had the highest proportion of nimbys, at 38 per cent, while the West Midlands had the lowest at 23 per cent.

The Times revealed last month that a consortium of housebuilders behind a new garden town in Devon had watered down its strict design code. The Sherford development on the outskirts of Plymouth was designed by the Prince of Wales’s architects to prove that his model village of Poundbury in Dorset could work on a larger scale.

The Prince’s Foundation for Building Community said that the builders, Bovis Homes, Linden Homes and Taylor Wimpey, used arcane planning laws to renege on their commitments to quality. Ben Bolgar, the foundation’s director, said they were determined to build a “normal, rubbish housing estate” instead. The consortium said the quality of the homes would not be affected.

Stewart Baseley, chairman of the Home Builders Federation, an industry body, insisted that his members “work closely with councils and residents to ensure the homes being built are what communities need”.

“Housebuilders have dramatically increased output to provide desperately needed homes,” he added. “Constructive debate is needed to develop policies that allow more homes to be built as opposed to baseless claims.”

“Since September last year, EDDC has been charging Community Infrastructure Levy (CIL) on certain types of new development.

The council passes 15 per cent of this income, or 25 per cent if a neighbourhood plan has been completed, to town or parish councils, with the remainder to be spent by EDDC.

The council is now inviting stakeholders involved in the delivery of infrastructure to bid for this cash by September 22, with a final decision to be made in February 2018.

Councillor Phil Twiss, EDDC’s portfolio holder for strategic development and partnerships, said: “The CIL is a fairer, faster and more transparent way of funding infrastructure delivery.

“It provides more certainty than the current Section 106 system, which is negotiated on a site by site basis.

“However, unlike 106 money, CIL money can be spent anywhere in the district.

“Unfortunately, the projected income from CIL falls a long way short of the total infrastructure costs required to deliver the Local Plan.

“This is because the legislation requires the charges to be set based on what is viable for developments to pay rather than what is required to deliver the necessary infrastructure.

“CIL was designed to be matched with funds from other sources in order to deliver projects and so difficult decisions will need to be made in terms of prioritising projects and projects should demonstrate what other funding would be used in addition to CIL.

“The CIL pot is never going to be able to meet all demands made on it and we will have a robust and rigorous qualification process in place to ensure that the money is well spent and in the right places.”

Rockbeare Parish Council objects to further expansion of Cranbrook

“… Cranbrook town council’s own planning committee objection to the application last month. And now Rockbeare parish council has voted to object to the application.

The objection says that it infringes on the emerging Rockbeare Neighbourhood Plan but also is premature, does not address the issues around congestion at the M5 junction 29 junction, the density of houses is too high, and the location of the all-weather pitch, the play areas, and the gypsy sites are in the wrong place.

Jacqui Peskett, locum parish clerk to the council says: “The application infringes on the emerging neighbourhood plan as the green wedge between Rockbeare and Cranbrook is intended to include the whole area to the east and north of Parsons Lane and that any development of the area to the west of the country park as proposed would potentially cause flooding in Rockbeare village.

“The proposal is premature, since there is still no overall development plan for Cranbrook, now promised for over three years, so issuing any more development permissions may seriously prejudice the proper development of a Cranbrook masterplan.

“The proposal does nothing to address the capacity of the M5/J29 which is already reaching overload at peak times.

“The developers have not learned the lessons of the first phase of development as the density of 45 homes/hectare is too high.

“The proposals makes no provision for healthcare and would exacerbate the already inadequate education provision in the area by adding a further primary school when the capacity of the secondary provision in Cranbrook is already at the limit.”

The objections also has concerns that the location of the all-weather pitch, the play areas, and the gypsy sites are in the wrong place.

But neighbouring Broadclyst parish council decided after a lengthy meeting that they have no comment to make on the reserved matters application.

Cranbrook town council had objected on the grounds that the green wedge between towns would be too narrow, the density of housing was too high and the location of the gypsy sites were in the wrong place.

Since the build of the new town in East Devon began in 2010, 3,500 homes, a railway station, St Martin’s Primary School, play facilities, the neighbourhood centre, local shops, the education campus, the Cranbrook Farm pub, while construction of buildings in the town centre and the sports pitches are underway, while plans for the ecology park in the town have also been submitted.

The application for the southern expansion for Cranbrook would see the town get an additional 1,200 homes, but also a petrol station, a residential care home, employment land, a new primary school, and an all-weather sports facility. …”

Now the bus company with the near monopoly in Devon, and which sends only single-decker buses through the town, issues a warning:

“Residents on newly built housing estates are being cut off from the bus network because developers are failing to construct wide enough roads, according to public transport bosses.

One of Britain’s biggest operators warned that buses were being forced to avoid many estates amid concerns over narrow roads, sharp bends, overzealous traffic calming and parked cars.

Stagecoach said that high-density developments were being built with roads only 6m wide, when operators needed 6.5m to allow two buses to pass without clipping wing mirrors.

It blamed planning rules that have cut road widths or pushed the layout of sharp bends to keep car speeds down.

The company also said that national guidelines introduced by Labour 17 years ago intended to clear roads of cars by providing less off-street parking had backfired, with many motorists leaving vehicles on the street.

Stagecoach has issued its own guidance to councils, urging them to build roads at least 6.5m wide, with sweeping bends and off-street parking provided.

It also said that “shared space” schemes that seek to declutter streets by stripping out kerbs, road markings and traffic signs should be redesigned to “avoid buses straying into areas intended mainly for pedestrians”.

Nick Small, Stagecoach’s head of strategic development for the south, said examples included the Shilton Park estate in Carterton, Oxfordshire, where the company could not operate a full-size bus, and the Kingsway development, Gloucester, which had areas “impenetrable by buses”.

Daniel Carey-Dawes, a senior infrastructure campaigner at the Campaign to Protect Rural England, said: “Bad design will lock our towns and countryside into toxic congestion and car dependency for decades.”

Martin Tett, housing and transport spokesman for the Local Government Association, said: “We will be looking closely at this blueprint and continuing to work hard to deliver places where our communities can thrive.”

“Pseudo-public space” – watch out Cranbrook

“Guardian Cities investigation has for the first time mapped the startling spread of pseudo-public spaces across the UK capital, revealing an almost complete lack of transparency over who owns the sites and how they are policed.

Pseudo-public spaces – large squares, parks and thoroughfares that appear to be public but are actually owned and controlled by developers and their private backers – are on the rise in London and many other British cities, as local authorities argue they cannot afford to create or maintain such spaces themselves.

Although they are seemingly accessible to members of the public and have the look and feel of public land, these sites – also known as privately owned public spaces or “Pops” – are not subject to ordinary local authority bylaws but rather governed by restrictions drawn up the landowner and usually enforced by private security companies.

The Guardian contacted the landowners of more than 50 major pseudo-public spaces in London, ranging from financial giant JP Morgan (owner of Bishops Square in Spitalfields) to the Tokyo-based Mitsubishi Estate (owner of Paternoster Square in the City of London) and the Abu Dhabi National Exhibitions Company (owner of the open space around the ExCeL centre)….”
